You can maintain a professional workplace relationship with Blacks but familiarity is what puts you at risk. Your personal life needs to be a mystery to them. Avoiding familiarity is really the key.

You won’t be able to avoid blacks if, for example, you take public transportation in Atlanta, but there is no pressure to socialize with them any more than there otherwise would be to talk to strangers on the bus (that is to say, none). Sorry, but no/extremely doubtful — provocation is not an excuse to commit a killing.

Assume you are correct about use of the ‘n word’ — this can be seen as provocation, and therefore, at the discretion of the court (or prosecution), as a mitigating circumstance; there is enough legal precedent for this — but in this case, there is also plenty of incontrovertible evidence, including video/audio, that the accused savagely beat the victim to death.

Also weighing against mitigation here is use of racial slurs by the accused — these were caught on video/audio.

In any case, a judge can set aside a jury verdict, e.g. if the ‘manifest weight of the evidence’ is contrary to it (Ito did not set aside the verdict in the OJ case; for that you can blame, more than anyone or anything, Mark Fuhrman).

In this particular case, given what is known, i.e. unless evidence of premeditation is uncovered, a charge of second degree murder (appears appropriate), or maybe manslaughter, seems probable — if second degree murder, and assuming mitigation via Jenks’ use of the ‘n word’, the DA may decide to reduce the charge to manslaughter — either way, a plea deal is likely, given the alleged video/audio evidence.

Another possible mitigation: the accused was intoxicated and/or under the influence of drugs.

Did Jenks defend himself? — was Jenks intoxicated or on drugs? — was the accused? — what was the motive?

You often hear ‘wrong place, wrong time’ — but this can be the result of questionable behavior, e.g. being at some seedy bar in the early hours, perhaps drunk, and around a rough/the wrong crowd.

ST. PETERSBURG, Fla. — The state has filed an intent to seek the death penalty for the charges of murder in the first-degree on a Bahamian man who is accused of beating a well-known St. Pete bartender and cook to death one night after both men left a bar.

Court documents say that video and audio recordings of the beating show that the attack lasted for an hour and 19 minutes while Kristoff King beat Scott Jenks. Jenks could be heard moaning, crying and pleading for his life.

Newly filed court documents say that the death penalty is being sought because the crime was “especially heinous, atrocious, or cruel.

“The capital felony was a homicide and was committed in a cold, calculated, and premeditated manner without any pretense of moral or legal justification.”

A combination of two things.

One, a lifetime of brainwashing had rendered him incapable of processing what was even happening, making him lack any drive for defense.

Two, the black would almost certainly have attacked by surprise, sucker punching him or perhaps hitting him with a weapon, causing critical damage right at the outset.

Look, no one will get away “scott free” with a killing by claiming provocation via a racial slur; anyone who believes that is deluded — at best this may result in mitigation, i.e. a reduced charge or a reduced sentence, but even that is at the discretion of the prosecution and/or the court.

Look at comment #51: the accused is being charged with first degree capital murder, meaning the state will seek the death penalty — the DA probably thinks the length of the beating shows the accused had plenty of time to consider and reconsider his actions and the consequences, and so per Florida law and precedent the requirement for premeditation is satisfied (which is probably correct); the judge will have to issue appropriate instructions to the jury about that — asking for the death penalty is due to the depravity of the crime; there is no doubt also relevant Florida law and precedent here.

Right now it looks like the best hope for this guy is a plea deal: plead guilty to first degree murder in exchange for a sentence of life without parole — I don’t see how any kind of mitigation would be allowed given such a brutal crime.
