In 1868, President Andrew Johnson was impeached for violating the Tenure of Office Act that had been enacted by Congress over his veto in 1867. Defying the law, Johnson fired Secretary of War Edwin Stanton, without getting Senate approval, as the act required him to do.

In his 1956 Pulitzer Prize-winning book, John F. Kennedy made Edmund Ross one of the Senate’s “Profiles in Courage” for his decisive and heroic vote not to convict and remove Johnson.

Repealed in 1887, the Tenure of Office Act was later declared unconstitutional by the Supreme Court.

But while the act was the lethal instrument to be used in the political assassination of a president whom the Radical Republicans meant to terminate, Stanton’s ouster was not the primary cause of their fury.

What truly enraged the Radical Republicans was Johnson’s resolve to be more magnanimous toward the defeated South than they meant to be. Johnson had in mind an earlier end to the military occupation of the South and a more rapid return of the seceded states to the Union.

The story is told in the 1942 Hollywood film “Tennessee Johnson,” starring Van Heflin, which has since gone down the memory hole along with Woodrow Wilson’s White House favorite, “Birth of a Nation.”

As historians concede, the impeachment of Johnson was about Reconstruction and who would remake the South. Would it be the Southern majority that fought and lost the war, or the victorious Yankees and the “scalawags” and “carpetbaggers” laboring alongside them?

The triumphant Radical Republicans were not about conciliation. So severe were aspects of the occupation that Gen. Robert E. Lee reportedly said if he had known what was coming, he might not have quit fighting.

So, too, the impeachment of Donald Trump is not really about his 10-week delay in shipping arms to Ukraine or his postponing of a visit by Ukraine’s president until he announced an investigation of Burisma Holdings and Joe and Hunter Biden.

Even before the 2016 election, Democrats, collaborating with a like-minded media, were using the instruments of power they possess, to first prevent and then to overturn the election results of 2016.

Russiagate, the James Comey FBI investigation, the Mueller probe — aborting a Trump presidency has always been the goal.

Saturday, White House counsel Pat Cipollone succinctly described to the Senate the bottom line:

“They’re asking you to remove President Trump from the ballot in an election that’s occurring in approximately nine months. … They’re asking you to tear up all of the ballots across this country on your own initiative, take that decision away from the American people.”

To save “our democracy,” to which they pay tireless tribute, the impeachers want to ensure that the people, in a supposedly free election in 2020, are not allowed to make the same mistake they made in 2016.

To save our democracy, the House and half the Senate want to deny the America electorate one of the most important roles the people play in this republic — the exercise of their right to choose the head of state and commander in chief of the United States.

Disqualifying presidential candidates whom populists favor but elites abhor is a quite common practice — in Third World countries.

Over the weekend, we learned that John Bolton, who has offered to testify in the Senate trial, claims in his coming book that Trump made a direct link between sending military aid to Ukraine and Ukraine’s opening an investigation of the Bidens.

This has caused some Republican senators to reconsider calling witnesses, particularly Bolton, in the impeachment trial.

If four Republicans vote for witnesses, they will be doing the work Adam Schiff, Jerry Nadler and Nancy Pelosi’s House failed to do in their haste to get Trump impeached by Christmas. They will be prolonging a trial set up to burn and bury their president.

The Senate should let Trump’s defenders complete their case, as the House managers and impeachers have already done. Then allow 16 hours of questioning. Then call for the verdict.

There is no treason, no bribery and no high crime in what the House managers allege. There is nothing in the articles of impeachment voted that rises to a level to justify removing a president.

Harry Truman dropped atomic bombs on defenseless cities and sent 2 million POWs back to the tender mercies of Stalin in Operation Keelhaul after World War II.

JFK greenlighted the overthrow of an ally, President Ngo Dinh Diem in South Vietnam, in a coup that ended in the murder of Diem.

LBJ ordered the wiretapping of Martin Luther King, and his White House shared the fruits of that FBI surveillance with a friendly press.

No one was impeached.

Why? Because Truman, JFK and LBJ were establishment favorites.

For Trump, a phone call with a Ukrainian president saying, “Send us your Biden file and we will have a meeting,” is a political capital crime justifying democracy’s version of a death penalty.

    The incident which sparked the Israeli and Polish rebuke was Ukraine’s public celebration of the 111th birthdate of Stepan Bandera. As the WWII leader of the Organization of Ukrainian Nationalists (OUN) and its military arm, the UPA, Bandera collaborated with Hitler’s Nazis.

    Holocaust historians hold Bandera responsible for the deaths of thousands of Jews and over 100,000 Poles.

    In response to the joint Israeli and Polish condemnation, Ukrainian Ambassador Gennady Nadolenko warned Israel to stay out of “internal issues of Ukrainian politics.”

    Undeterred, the Israeli Foreign Ministry shot back the statement that “individuals responsible for the murder of Jews in the Holocaust and in the pogroms, as well as the anti-Semitic ideologists of the Ukraine National movement have recently been subject of public glorifications in Ukraine.” The Israeli Foreign Ministry “condemns those phenomena.”

    It may be recalled there was some controversy last August when uninformed Canadian soldiers were paraded at a monument dedication in the Ukrainian village of Sambir. What made this incident controversial was the fact that the monument was being dedicated to 17 members of Stepan Bandera’s OUN fighters, which Israel and Poland vehemently condemns as Holocaust collaborators.

    It is one thing for Canadian citizens to have a collective ignorance of the extreme horrors of the Holocaust, it is another matter altogether when Canadians in uniform are paraded to honour the memory of those Ukrainian Nazi sympathizers who perpetrated this atrocity.

    May we never forget, never revise and never deny the magnitude of the inhumanity of Hitler’s Holocaust.

    How can Bolton have any credibility as a witness against Trump? He was fired by the man after being at odds with Trump’s policies throughout the months he occupied his office. And he was never complacent or quiet about those facts at any time after his removal from office. He clearly has an axe to grind, should be considered prejudicial to Trump’s case and rejected as a witness with anything objective to say on this case. Trump has already called Bolton a liar. Be foolish of him to do so on the witness stand opening himself to no end of preposterous cross-examination, but I’m sure he’d swear to it on a stack of bibles in the National Cathedral. Rather than voting to allow Bolton to spew damaging testimony against their president, the GOPers ought to deny the introduction of any new evidence not presented by the House manipulators, I mean managers, along with the articles of impeachment, vote to summarily dismiss the case, and open an investigation of Joe Biden’s corrupt dealings in Ukraine, when he basically served as President Obomber’s viceroy of that country. I’m sure the Dems would scream that would be interfering with the current national election, which is the exact same thing they are attempting to accomplish with this impeachment fiasco.

    There is no organized Left in American politics, has not been for generations. There is right-of-center and far-right, that’s all. Corporate money flows by the hundreds of millions to both parties. Yet in poll after poll a substantial majority of Americans are in favor of Medicare for All, lower prescription drug prices, more affordable childcare, higher taxes on the rich, limits on campaign spending, addressing the climate crisis, and other supposedly extremist positions. The powerful mischaracterize these policy ideas as “fringe,” or “radical,” or “socialist” because these initiatives would cost them money, requiring either higher taxes on them or regulations that might cut into their corporate profit.

    All this prattle about Leftists in charge here, Leftists running the show there, Leftists pulling dirty tricks everywhere reminds me of the WWII anecdote of the impoverished German Jew who religiously read the Nazi daily Volkische Beoachter because he enjoyed reading its propaganda about how powerful his marginalized, hated community was after all.

    I’m surprised Pat didn’t mention the near-impeachment he is much more familiar with, that of Richard Nixon. Nixon’s presidency was paralyzed long before any talk of impeachment articles, and probably for the same reason as is happening to Trump: peace with Russia.

    Today we think of Nixon as red-baiter, a crook, or the guy who dropped lots of bombs on North Vietnam. But his most important achievement historically was his pragmatic approach to USSR/Russia. That all ended with Watergate.

    As Len Colodny, author of “Silent Coup: Removal of a President,” notes, we went from Detente to the Evil Empire in ten years. Suffice to say, even if Trump survives impeachment, he will be much too hobbled to pursue the friendship with Putin he promised in the 2016 campaign.

    Apparently there is someone out there that really, really does not want to see a unified Christian civilization stretching from Washington to Moscow.

  12. I don’t quibble with Pat’s above assessment of the unjust and unjustifiable nature of the impeachment trial of President Trump. And, I too believe that with the 2020 elections coming so soon and with the Democrat field of potential candidates so incredibly weak (they seem to want to give away money in the trillions taken from the pockets of ordinary citizens who will never benefit from those give-aways) that 1) Trump is almost certain to be re-elected and 2) that, rather than impeachment at this late hour, the American people should be entitled to either accept a Trump reelection or reject it via the ballot box.

    I supported Trump in 2016, mostly because I thought his campaign statements in opposition to America’s endless wars were genuine and that Killary’s tendency to support endless wars and even to increase their number was clearly reflected in her political past and her many bellicose statements.

    However, I now sense that Trump is either personally and deliberately angling for a war with Iran or has somehow been unduly influenced by others to do so. In so doing he is thereby demonstrating an abandonment of his clearly stated principles against foreign conflicts during his election campaign. Therefore, I feel deceived by him.

    I always vote in both local, state and Federal elections. And, I’ll do so too in November of 2020.

    BUT I’LL LEAVE THE CHECK BOXES FOR PRESIDENT BLANK, UTTERLY BLANK.

    Why does he have to “admit that (other politicians are also bad)”? It’s irrelevant. Trump deserves to be impeached and removed from office regardless of whether Obama deserved it or not. (And for that matter why didn’t the republicans impeach Obama for his crimes, e.g., being legally ineligible to be president, etc., when the republicans had a chance to do so)?

    Just like he said, Trump is a “nasty, unethical, dishonest, completely self-serving man”; and I would add that Trump is a very dangerous man, much more so than most of his predecessors.

  27. I was in the room with my wife when The View came on. I cannot stand those shrieking beasts (esp. unfunny commedian Joy Behar), and avoid that show like the plague, but stuck around because Alan Dershowitz was a guest. I’m generally not a Dersh fan, but I’ve admired his principles in support of the Constitution, as he has blasted this impeachment farce for months. To my knowledge, no other big time democrat Jews have done so.

    Anyway, the 3 leftists on the panel (Woopy, Joy, and Sonny) were so demented in their blood lust as to make one wonder if the 19th Amendment was such a good idea. Finally, it was Meghan’s turn, and I was happy to see that, even though the President had been entirely disrespectful of her father, she was able to look beyond that and see that this impeachment idiocy was a terrible idea. She was also the only one who had the good manners to address him as “Mr,” and the only one to ask her questions without shouting.

    Meghan brought up that there are at least 4 democrats (she named them) who are leaning against removing Trump, and even Sen. Feinstein is getting second thoughts so close to the coming election. With the democrats cracking, if the republicans can stick together in opposition to more witnesses, one hopes that this national nightmare will be over soon, and they get back to trying to govern.

    Odd that war monger John Bolton is looked upon as the democrats new savior. That’s all they got left. As Dershowitz pointed out, it doesn’t matter what Bolton has to say. There is still NO CRIME. I only wish that AG Barr would put Schiff and Nadler in handcuffs, and charge them with Sedition. That’s what Lincoln would have done.

    If they were actually center-right then they wouldn’t be so obsessed with guns or racial politics. They wouldn’t be spending time arguing about tranny bathrooms or reducing meat consumption.

    Well for the sake of historical accuracy it wasn’t entirely fictional as German Communist leaders were disproportionally Jewish. I’m not saying that justified the Nazis but I don’t care for this revisionist history that tries to completely ignore that unfortunate fact. Feel free to do your own research on the subject.

    The Communists were in fact plotting to takeover Germany as they had already tried post WW1. I think we need an honest assessment of history to understand what factors led to war and not a complete dismissal of certain facts just because they don’t fit our narratives.

    The last I checked Trump never issued dire threats to any racial groups that support Democrats and in fact mollycoddles blacks and hispanics just like all Republican presidents.

    They did. 58 Senators voted against it in a Senate resolution. The JCPOA was a treaty which requires 66 votes for Senate ratification. Obama didn’t have the votes to properly ratify it so instead used the 42 vote filibuster against overwhelming Republican opposition as “approval”. Looked at another way only 42 Democrat Senators supported ratification which is far short of the 66 needed.

    Treaty ratification in the Senate of 2/3 majority is a Constitutional requirement and must be changed via Constitutional amendment. That Obama unilaterally ratified the JCPOA treaty was totally unconstitutional yet Harold Smith didn’t cry out for impeachment because he agrees with the JCPOA. So presumably U.S. presidents can violate the Constitution with impunity as long as they don’t offend the sensibilities and political leanings of Mr. Harold Smith, but if they do then look out.

    How can you untie yourself from this Gordian knot you put yourself in, Harold? Almost every president going back to Abraham Lincoln acted in violation of the Constitution and thus, committed impeachable offenses.

    I’m not enamored with Trump like you think I am and vehemently disagree with many of his recent foreign policy actions but you can’t hold him to a higher and different standard than previous presidents and impeach him for less than GW Bush and Obama.

    Using your “El Capo” analogy and “reasoning” if El Chapo helped institute the JCPOA in some way then he should be let out of prison despite all of his other bloody crimes visited upon people, or at least get a reduced sentence.
