[Excerpted from the latest Radio Derb, now available exclusively through VDARE.com]

Of the sixteen persons nominated for a cabinet position, as listed in the January 23rd issue of The Economist [After the chaos of the Trump era, what can Joe Biden hope to achieve?] nine have now been confirmed by the U.S. Senate and have assumed office. So we are better than halfway through the confirmation process.

You can’t help but notice the diversity. Not one of them—not one of the sixteen—is a non-Hispanic white Protestant heterosexual male. To put that another way: Not one of the sixteen comes from the same slice of the diversity pie as did every single one of our nation’s Founding Fathers.

(Am I still allowed to say “Founding Fathers“? “Founding persons,” whatever.)

That is the working definition of the word “diversity” in our benighted age: no non-Hispanic white Protestant heterosexual males! That’s true diversity!

Only one of the sixteen is a white male Protestant: Peter Buttigieg, the Transportation Secretary; and as an Episcopalian, his Protestantism is borderline. I used to be an Episcopalian, and I recall that bit in the liturgy where we prayed for the Holy Catholic and Apostolic Church.

Confessionwise I count eight Roman Catholics, four Jews, two Protestants, one Hindu, and one unknown. By sex they break down as ten guys and six gals. Cutting by race and ethnicity: ten white, three black or blackish, three Hispanic. By sexual preference: fourteen apparently heterosexual, one homosexual, one unknown.

Concerning the confirmation process itself: There is a customary understanding—a sensible one, I think—that a new President is entitled to his cabinet picks, and that the Senators should practice forbearance in challenging them, with due allowance for a bit of televised grandstanding on particular issues. Given that, and the present balance of parties in the Senate, these confirmation hearings are somewhat of a formality.

They can be instructive, though. Instruction this week came from Merrick Garland, picked by Biden—or whoever pulls Biden’s strings—to head the Justice Department.

Justice in the U.S.A. is in serious trouble. It has been politicized. Our Ruling Class has been seized by an ideology: the one loosely called “Wokeness,” although as a longtime fan of Professor Paul Gottfried, I prefer “Cultural Marxism.” This ideology has many facets, but its most central characteristics are 1) deep hostility to the founding stock of the U.S.A.—as illustrated by the statistics I just gave you on Biden’s cabinet picks—and 2) fierce intolerance of all dissent.

In the matter of justice, the effect of that ideology has been to give us a two-tiered system, a shameful double standard. Anarchist mobs who burned, looted, and murdered their way through our cities last year have been smiled on by the courts. The motley protestors who entered the Capitol on January 6th, by contrast, are being hunted down and crushed like bugs: no bail, no celebrity support, no GoFundMe pages, no allowance for personal circumstances.

Sample quote from my new journalistic heroine, Miranda Devine:

As for Portland, Oregon, charges were dropped for 90 percent of rioters arrested in September’s anti-cop violence. One 23-year-old charged with attempted murder, arson, possession of a destructive device, and rioting was released on a $1,000 bond.

Seattle was as bad. Mayor Jenny Durkan lauded the lawlessness that would lead to the fatal shooting of 19-year-old Horace Lorenzo Anderson in July as a “summer of love.”

These were the deadly protests Biden benignly described as “peaceful” and [Kamala] Harris said are “not going to stop … and they should not.”

Yet after a few hours of madness one day in January, every Trump supporter in the country is to be treated as if they flew a plane into the World Trade Center. They all are under suspicion for what Biden said last week was “the greatest threat … in America: domestic terror.”

Plainly—it could not be more plain—there is one system of justice for persons who hold approved opinions, another for dissidents.

Anglo-Saxon jurisprudence has of course always allowed intent as a factor in the dispensing of justice: an unintended homicide is treated differently from an intended one.

But that principle has now been distorted to:

  • If I burn down your store because of some grudge I bear, not towards you but towards society in general, I will not be punished so long as my grudge is a good fit for the Ruling Ideology.

But:

  • If I enter some federal building unarmed with the vague intention of disrupting a parliamentary procedure—even if uniformed security personnel let me in—and then I put my feet up on a legislator’s desk, I shall be prosecuted to the fullest extent of the law, so long as my intention, or any of my personal connections, are at odds with Regime Ideology.

This gross and obvious double standard is Third World jurisprudence. It’s how things are done in Congo, Uzbekistan, China, or Guatemala.

No American jurist with any respect for our nation’s history or constitution should tolerate it.

But Merrick Garland doesn’t just tolerate it, he approves it. Asked about last year’s attempt to burn down a federal courthouse in Portland, Oregon, Garland mumbled that no, that wasn’t domestic terrorism if it happened at night when no proceedings were going on.

Garland’s responses to similar questions were likewise tilted towards the anarchist mobs rioting in support of Ruling Class ideology and against citizens hostile to that ideology.

It’s as clear as can be that, as Attorney General Garland, won’t challenge the double standard, much less dismantle it; he will bolster it.

Our one crumb of consolation here: at least this stuttering doofus is not on the U.S. Supreme Court (where most of our significant legislating actually gets done nowadays). Barack Obama, in his last year in office, proposed Garland as a replacement for—Heaven help us!—the late, brilliant, patriotic Justice Antonin Scalia. (Speaking of diversity, Garland’s elevation would have meant that four of the nine Justices were Jewish).

In that instance, at least, Heaven did help us. The congressional Republican Party, in a rare display of spine, ran out the clock on Garland’s nomination.

That won’t happen with this nomination. Garland will be approved as A-G. He has already told us that his priority will be hunting down and prosecuting patriot dissidents, while smiling benignly on the Antifa and Black Lives Matter enforcers of Regime ideology.

We shall soon see the double judicial standard in courtroom action. The state trial of police officer Derek Chauvin seems now definitely to be on for early March. [Court: Derek Chauvin’s Trial Set For March Will Be Held In Person, CBS Minnesota, February 3, 2021]

ORDER IT NOW

Last time I reported on this there had been some dithering by Minnesota’s black Muslim communist Attorney General Keith Ellison. Should Chauvin and the three other officers present at George Floyd’s arrest be tried all together? Should they be tried while the Covid pandemic is waxing strong, or in the summer, when presumably it will have abated?

The decision has been that Officer Chauvin will be tried next month, the other officers in August.

As I told you a month ago, and as Steve Sailer has just been telling us again, the barbarous and unconstitutional practice of double jeopardy will be in play. If, by some mischance, People’s Commissar Ellison can’t rig up a jury conviction of Officer Chauvin on the charges of homicide—or, on the James Fields precedent, likely even if he can—the feds will step in to prosecute Officer Chauvin for homicide-while-thinking-bad-thoughts.

Attorney General Merrick Garland will be just fine with this. He will throw all the resources of the Justice Department at Officer Chauvin, and then all over again in August at the other three officers.

If you’re thinking that it’s hard to imagine a creature as limp as Garland throwing anything at anyone, I’m inclined to agree; but in this case he will be energetically assisted by his Assistant A-G for the Civil Rights Division, fanatical white-hating black supremacist Kristen Clarke.

Emboldened by the destruction of Officer Chauvin, the feds will then turn their attention to the arrested January 6th protestors, with similar malice aforethought. And after that the FBI—which is a tool of the Justice Department, remember—will go scouring the land for persons who might in some way have encouraged or supported those “domestic terrorists.”

The next year or so will see one of those descents into authoritarian savagery that have blotted history so often before, in different times and places: the witch-hunting panics of early-modern Europe, the terror phase of the French Revolution, Stalin’s purges. I doubt it will go as far as public executions, or dissidents being shot in FBI dungeons, but many lives will be destroyed.

Through it all Merrick Garland will be smiling vacantly or mumbling CultMarx platitudes, and Kristen Clarke will be cackling gleefully.

For our liberties and for our traditional Anglo-Saxon jurisprudence—what’s left of it—this will be a long four years.

Meanwhile, quietly, hesitantly, cautiously in the background, resistance will be rising.

    No, dissidents are seldom shot in FBI dungeons, they’re more often shot in the street for “resisting arrest” or something. And if they’re classified as “terrorists” their house & personal possessions can be confiscated. But America is a civilised country so no “cruel & unusual punishment”, certainly not under Tikkun Olam Garland.

    I wish I could be as sanguine as you are about this, but, alas…

    Some of my in-laws would gleefully approve of public exposure, humiliation, torture and execution of Trumpians–all without due process. They are Catholics and Catholics–such as Nancy Pelosi– don’t care a whit for English due process.

    How can you reason with a person who believes that a mere human, the Pope, is infallible? Any attempt to reason with them is regarded as proof that you are unworthy of being treated as a decent human being, since you are ipso facto, a tool of all that is opposed to what they regard as unalterable, unchallengeable truth.

    No, I’m afraid that we’ve lost not only the battle, but the war as well. My in-laws hold to their beliefs with a fanatical, self-righteous stubbornness. I have seen them literally, eyes alight, rise up in a righteous rage as they savagely attack any notion that differs even slightly from their canonical beliefs. To them, disposing of heretics is not merely justifiable, it’s virtuous. They bring the same mindset to the political arena. Impartial search for Truth has no place in their eschatology.

    And, it is. I’ve written before that something the ctrl-left learned back in the 1960s is that there’s great power in numbers. Not enough people participated on January 6th.

    However, how about some huge crowds, growing daily, outside the courthouse where they get railroaded, errr, tried, as James Fields did? How about the same for the trial of Kyle Rittenhouse? How about a large general strike by White Men, something I never would have thought we’d need to get to only 10 years back?

    The problem right now is that White Men still have too much to lose, or think they do. That is changing quickly too, as this economy is not going to get any better.

    Mr. D- clearly, you didn’t learn much while you were in the TEC. ALL Christian churches claim parity as part of the ‘One, Holy, Catholic, and Apostolic Church.’ It’s called the NICENE CREED.

    Lutherans, Presbyterians, Methodists, Catholics, Orthodox, and yes, Biblical ANGLICANS all recite this every Sunday, as they are SUPPOSED TO. What the modern feminist/sodomite ‘Episcopalians’ do, is anyone’s guess.

  10. It was a big mistake to include any special recognition of religion in America’s founding documents. To do so enshrined and elevated irrationality. There is no reason to treat churches any differently from any other business. I don’t give a crap what people believe, so long as they don’t try to force me to profess to believe it – but when I encounter a committed bible-thumper, I have the same reaction as I do to freaks like Rachel Levine: “This person is a head-case. How can I be expected to take seriously anything he says?”

    From what I have seen, Garland was not asked about the fact that Trump vs. Hawaii did not legally overrule Korematsu. Internment remains the law of the land. Thanks, Justice Roberts. Justice Jackson, dissenting in Korematsu, wrote that Korematsu would lie about, like a loaded weapon that would lie ready to be fired upon a plausible showing of need. Someone should have asked Garland to promise that under his justice department, the weapon of group internment would never be fired. Someone should ask Jen Psaki how Biden feels about this. Would she give her usual answer of “we consider everything” and then go back to fussing with her hair?

    The article in general, and this above quote in particular, reminds me of an anecdote.

    While in college way back when I heard the Israeli statesman Abba Eban give a speech during which he thundered “Israel must be Jewish and democratic!”

    An Israeli friend sitting next to me rocked in his seat with supressed laughter.

    I gave him a What’s so funny? look. He leaned over and said, “How can anything Jewish be democratic?” Then it was my turn to rock in my seat with surpressed laughter.

    I never forgot that.

    I also never forgot what he said later after Eban’s speech and in reference to Eban’s statement quoted above. He said, “Jews are the smartest and the dumbest people at the same time.”

    Something worth keeping in mind when considering the actions of those pulling Biden’s strings. And not just Biden.

    One obvious takeaway, at least it’s obvious to me, is that, though they might be good at infiltration, subversion, betrayal, destruction and death, they’re no good at social management.

    And that’s definitely worth keeping in mind as current events continue to unfold.

    Probably that’s essentially true. But – there are degrees. A belief based on science or some kind of objectivity is likely to be more reliable than one based on naught but metaphysics. Thus science will tend to help us more than religion. It’s say the difference between praying over a snake bite & giving a shot of appropriate anti-venom. (Of course, one can say that religion gives one more reason to live than science — perhaps that’s true for many — but one could equally wonder whether that’s an ideal situation.)

    The problem for Conservatives is that they tend to be Reason Uber Alles folks, continually blind-sided by things they can’t see.     Amusingly and interestingly, you just reminded me of something. I’m 60 and when I was in grade school over 50 years ago, teachers could still paddle kids (not a great idea but, I’m not looking to get into that here.)

    I had a first-grade teacher who didn’t prefer that approach but, what she would do if a kid was really not stopping some errant nonsense, after being told to, at recess or before/after class is: she would put both of her hands on each of your shoulders and shake you. A ‘snap out of it’ kind of approach. She spoke also as she was doing it but, honestly, it was those longish, red fingernails digging into my shoulders and the shaking that would stop me in my mental tracks. It only happened a couple times to me because you learned pretty quickly to avoid that. It was humiliating and did give an unruly kid pause (and time to recalibrate).

    I’ll never forget her name or that scenario whereas I couldn’t tell you the names of most of my teachers in the grades after that. Moral of the story: shoulder shaking is an effective approach!

    If you’ll allow me, maybe I can offer some insights from my own life experience.

    First, the mark of an intelligent man or woman is to see nuance, details, shadings, differences. People of lesser intellect see black and white. Further, we change as we age and gather experience and apply our intellect to it. It’s called wisdom, and it’s the reason for the saying: “Youth is wasted on the young”.

    In short, you sound like a very bright person who is introspective and willing to be self-critical and self-assessing, and thus open to reasonable self-doubts that lead to change, growth and wisdom. These are wonderful qualities. You’re probably a person I’d love to share a hot tea and chat with a while (I’d say a beer, but I cannot drink due to stomach issues.)

    As for being able to “win friends and influence people” (as the old Dale Carnegie course tooted), you are not alone in that regard. It’s called salesmanship, and for those that have that ability, I tip my hat. I am not a ‘salesman’. When I practiced law as a civil litigation attorney, I learned the hard way about being a good salesman. The best jury trial lawyers are great salesman, as are successful politicians. It’s having the ability to quickly sense and assess the needs of those around you and be all things to all people, usually coated in lowest common denominator sugar for easy swallowing. Sadly, it works. Too well, actually, as we can see by the sorry state of things across the globe.

    To be perfectly honest, I was mediocre as a jury trial lawyer, or in your words, “ineffective”. But I’m a relatively quick learner. I realized that my strength was intellectual rigor and better-than-average logic skills (without undue modesty.) Thus, it only took me two jury trials (lost one, won the other) to realize I would serve my clients best by trying my cases before judges and arbitrators rather than normal folks selected from a jury pool of people not intelligent enough to get out of doing jury duty for a few measly bucks a day, usually. After making that decision I basically never lost again. It was the best professional decision I ever made.

    The vast majority of people are not terribly smart, usually overworked and rarely open to having their opinions changed. They like things easy and predictable. Things new and challenging scare them away. Thus, winning hearts and minds is tough work, really tough, unless you’re a natural born salesman who knows how to quickly assess people’s needs, especially emotional, and manipulate them accordingly.

    I’m not a good ‘manipulator’. I don’t feel I have that innate ‘salesman’ ability, nor did I feel the need to develop it, as the term ‘salesman’ is akin to ‘pedophile’ in my lexicon, usually appendaged to “used car”. From what you say, it would seem neither do you. And to my mind that is not a bad thing at all.

    In short, your journey of self-knowledge and internal dialog and evolution are to be admired. As for effectively reaching out to people, simply sharing such personal insights here on Unz is a fine way to engage people with your message, whatever that may be. You did so with your post and reached at least three people who took time to acknowledge your efforts. This is mine.

    The best hope is an uncertain one but it amounts to defeat in war against Russia and China. The regime might then be removed from power as part of a peace settlement. Even so it will be very apparent that the US as we knew it before 2020, the US mythologized by the American Revolution, the shining city on a hill, will have passed into history. The US will have demonstrated that it is certainly not uniquely blessed but as capable as any other country of producing the great horrors found in history.

When children are mutilated in FGM it is, rightly I believe, a great Evil, but when children as young as three are convinced that they are not boys or girls, and those under the age of majority are drugged and mutilated, it becomes some sort of unquestionable process. And the parents who push this onto their children are suffering some variant of Munchausen’s by Proxy, I would say.

    Sadly, white liberty and jurisprudence has included black lynching and wholesale incarceration of black and Hispanic male youth as a means of monopolizing political power and economic prosperity. Losing or surrendering some of that power is not Cultural Marxism, it is doing the right thing. The powerful are dominated by Conservative thinkers who will never surrender power willingly.

    Our founding Fathers intended to stack the deck against women and blacks. Fortunately, we have improved on these flawed original constructs which so many conservatives seem determined to preserve. But police violence against progressive advocates for change is deeply institutionalized, not random individual misbehavior. This does not necessarily mean that Officer Chauvin should be subjected to double jeopardy, only that the history of police violence in this country is that police are the front lines in the endless class war that protects the ruling class from the working class and those in power want the police on their side at all times.

    Biden has made some excellent, good and poor selections for his cabinet and staff. Giving a native American a seat at the table in determining their own destiny is an excellent example. Preserving the US war machine is a bad example. I can’t help but think that the selection of Garland is a way to rub salt in McConnell’s ass and I applaud him for it. No one is more deserving .

The fact that a florist or baker has to use a religion argument to avoid being forced to do business with someone against his wishes, a charity has to use a religion argument to avoid paying for birth control pills for its employees or beneficiaries, and a church has to use a religion argument to stay open when other entities are closed by the government is unfortunate. Simple human-rights principles of free association or economic liberty should suffice.

    Nothing could be further from Christian Doctrine according to which, when one dies, one is utterly and truly dead. After Christ’s return, the dead are risen and brought to judgement and only after that has occurred does the “recreation of the (perfected) psycho/physical being” take place.

    The popular notions of dying and going immediately to Heaven or Hell have no place in official Christian doctrine, yet the same people who espouse this popular heresy will accuse me of not being Christian because I stay home and listen to the Messiah rather than going to Christmas Mass and listening to Rudolf the Red Nosed Reindeer on the way there during Christmastime.

    So, no, I don’t agree with your observation about the five year olds. I used to believe that to be true, but I have come by facts that were presented to me by people who were wiser (and likely smarter) than I and have changed my mind in light of them. When it comes to joining teams, I believe it prudent to go with the smart guys/gals. When I climb into that lifeboat, I want to be with the navigator, the guy who can read the stars and use a sextant.
