Why the Golden State Killer May Keep California’s Death Penalty Alive

… Gov. Gavin Newsom, a Democrat, issued a moratorium in March on executions in the state, which has more death row inmates than anywhere else in the Western Hemisphere. But that decision has not stopped local prosecutors from seeking new death sentences, underscoring the divide in the state between conservative prosecutors and liberal reformers like the governor.

And as liberal as California voters are generally, as recently as 2016 they rejected a ballot measure that would have abolished capital punishment, and approved another one to fast-track executions. …

New death sentences in California have declined in recent years; 2018 was a record low, with five new sentences. The drop aligns with a national trend, as public support for capital punishment has waned and juries have been reluctant to impose death sentences in the face of evidence of racial disparities and high-profile exonerations….

Many supporters of capital punishment say that while the system can be reformed to reduce racial disparities, and thus produce fewer death sentences, the penalty should remain an option for prosecutors and juries in the most heinous of crimes, including some of the cases underway in California. …

Research that shows racial disparities in the capital punishment system — that black and Latino men are disproportionately sent to death row — has led to an acknowledgment that the system is flawed, and is at the heart of calls for abolition. But in California, supporters of the death penalty argue that white men are charged with committing some of the most egregious crimes, including Michael Gargiulo, the Hollywood Ripper suspect, or Mr. DeAngelo, who was once a police officer.

“Gargiulo is a white dude,” Ms. Hanisee said. “Golden State Killer, he’s a white guy who was a cop.” She also noted that many of the 24 death row inmates who have exhausted all of their appeals — and would be next in line for executions if they were proceeding — were white men.

“Of the 24 or so who are presently eligible for execution, half of them are white men,” she said. “So let’s execute them.”

Interesting … So I guess I was lied to by all that “It’s OK To Be White” graffiti …

    It’s not quite that straightforward. She desperately wants to come across as being just as tough on crime as those awful conservatives it’s just that being tough on blacks would be punching down since she’s a white supremacist, so the white inmates get the brunt of her performance.

    She's a deputy DA (i.e., a pig). Pigs are loyal to blue and blue only. The supposedly liberal NYT will print anything a pig says without challenge. The death penalty is basically the full employment act for pigs.

    The most catastrophic disastrous mistake ever made by western civilization in with ts history was extending the franchise to women. Absolutely, it will eventually prove the literal death of the west and western man.

    The new NYT columnist Michelle Alexander is a big advocate.

    She’s also a law professor. So is Richard Delgado, who argues the first amendment allows the government to ban “hate speech.”

    Their salaries are paid for by federal student loans, which are mostly not paid back anymore due to an Obama policy called “income based repayment.” After 25 years of such payments, which are often zero or reduced by 80%, the rest is forgiven. And “public service” results in federal loans being forgiven in 10 years.

    Trump’s biggest failure outside of immigration policy is not scaling back student loans as much as the Supreme Court will let him, which is possibly quite a lot.

    Indeed. Abolishing the death penalty essentially means you are lowering the "cost" of committing all violent crimes. Once the worst murderers are only receiving life in prison the less heinous murderers will inevitably get some punishment less than life. See Europe as an example.

    And of course the only reason a murderer ever accepts a plea bargain for life without parole is because the alternative is death. What bargain do you offer them if the worst they can get is life without parole?

  10. On January 17, 2006, California executed Clarence Ray Allen, who was 76 years old, legally blind, diabetic, and used a wheelchair. He was the last person the state has executed.

There, Hamilton murdered Schletewitz and fellow employees Josephine Rocha, 17, and Douglas White, 18, with a sawed-off shotgun and wounded two other people, Joe Rios and Jack Abbott.[3] Hamilton shot Schletewitz at near point-blank range in the forehead and then killed Rocha and White after forcing them to lie on the floor of the store.

    You also need to think about the trillion+ in outstanding student loan debt.

    The Affordable Care Act showed us that their are no limits on government power as long as it's in the form of a tax. As I understand it, fedgov steps in with loan guarantees to the loan holder if the debtor is delinquent. They also act as the enforcement agent free of charge. Trump could tax the guarantee payments at say... 100 percent, plus a a bit more to cover enforcement.

    It would be great to defund these a*holes. However, to do that Trump--any other Republican--should be offering an alternative to counter the spin that Republicans are pissing on the middle class.

    That alternative is
    1) Certification exams -- and the use of them for government hiring.
    Certification exams where people can prove their competence at both general reading/writing/math competence and specific subject areas.
    And then critically the feds switch to using said exams rather than undergrad degrees for all their hiring.

    2) Free on-line courses.
    Create a platform that would host on-line courses. Leave the courses up to any university professors--or anyone else for that matter--that wants to create them. But compensation would come only from actual usage--through to the end--by students, and taking an associated exam.
    In lieu of student loans, students--all citizens--would have a "credit" they could spend on at this on-line "university". But it wouldn't be limited to "university" either, technical, skill-trades training--the knowledge base part at least--would be available as well.

    Platform would, of course, have a rating system where students could rate the quality/usefulness of the courses they'd taken, so platform itself would serve as a market.

    -- working around college bloat and indoctrination
    -- individual pace
    -- better quality instruction
    -- lower costs
    -- de-employing lots of leftists--sending them out to work for a living
    -- giving kids--as early as young teenagers something to actually work toward; probably actually motivating a lot of teenagers who at present just sort of wait to be done with high school
    -- depressurizing the whole Yale or Jail college nonsense
    -- reduced young people debt
    -- faster transition to adulthood
    -- both of the previous leading to faster more "affordable family formation"
    -- lower "financial penalty" for having and raising kids

    It's a huge deal.

    Education is one of the easiest things to scale up, make more efficient with technology ... but we're still doing it basically with an expensive--gather everyone together in this classroom--Fordist model. It's nuts.

    Where is the evidence that local prosecutors seeking the death penalty are conservative as compared to other prosecutors similarly situated? Perhaps the viciousness and cruelty of the crime committed has some basis for the penalty sought…

    It might be argued that Newsome issuing a moratorium on executions for death row inmates creates an uncertainty regarding punishment that is unconstitutional, i.e. it is effectively temporary at Newsome’s whim, or term of office, whichever ends first.

    And what kind of pretzel logic aligns a state population that…

  20. Progressives actually love punishment provided it’s meted out to the right people. They want fewer prosecutions and lighter punishment in the name of reducing disparities in the population of the incarcerated, but are strongly supportive of hate crime laws intended to come down extra hard at sentencing time to perps with the wrong victims, despite no evidence that such laws would serve as any kind of deterrent.

    According to the wikipedia article on “race and crime in the united states”, in 2013, non-hispanic whites comprised 33.5% of those arrested for murder. Given known racial and ethnic murder rates, and California’s large hispanic population, it’s likely that non-hispanic whites are a much smaller proportion of murderers, but’s let’s assume that alot of the guys on death row committed their crimes a number of years ago, when California was still a majority white state. So, taking the extremely generous estimate that whites commit 33.5% of California’s murders, they nevertheless comprise half of death row, an overrepresentation of 50%. She’s right – there are massive racial disparities in imposition of the death sentence.
     
    That could simply be due to the fact that they chose to kill white victims.

    Perhaps not everywhere always, but over the centuries in this country the seriousness sof murders ahs gone like this from most serious to least:

    The Affordable Care Act showed us that their are no limits on government power as long as it’s in the form of a tax. As I understand it, fedgov steps in with loan guarantees to the loan holder if the debtor is delinquent. They also act as the enforcement agent free of charge. Trump could tax the guarantee payments at say… 100 percent, plus a a bit more to cover enforcement.

    In lieu of student loans, students–all citizens–would have a “credit” they could spend on at this on-line “university”. But it wouldn’t be limited to “university” either, technical, skill-trades training–the knowledge base part at least–would be available as well.

    Platform would, of course, have a rating system where students could rate the quality/usefulness of the courses they’d taken, so platform itself would serve as a market.

    That's one way of looking at it, but it would be wrong.

    Blacks tend to be more impulsive, so a lot of black murders are crimes of passion - killing loved ones (especially ex- or soon-to-be-ex-lovers), "business associates" (aka fellow gang members), etc. Such murderers tend not to be charged with the death penalty, since they often aren't premeditated and aren't the most violent of murders.

    The average black-on-white murder tends to be a lot more horrific and gruesome than the average black-on-black murder. They often involve victims they don't know, and there is often a secondary crime involved, like torture or rape.

    I can think of literally dozens of such horrific black-on-white murderers over the last year or so. Plenty of similarly horrific white-on-white murders, as well. But how often do you hear of murders like that that are white-on-black? Almost never.

    All that's happened is that the anti-death penalty folks, and the race obsessed folks, have tortured the data endlessly looking for an angle that makes it appear that the death penalty is biased.

    The truly horrific racism is all of the so-called civil rights groups fighting to get blacks off the hook for murdering whites, no matter how gruesome.

    Indeed. Abolishing the death penalty essentially means you are lowering the “cost” of committing all violent crimes. Once the worst murderers are only receiving life in prison the less heinous murderers will inevitably get some punishment less than life. See Europe as an example.

    And of course the only reason a murderer ever accepts a plea bargain for life without parole is because the alternative is death. What bargain do you offer them if the worst they can get is life without parole?

    Actually, iirc, that isn’t what the research shows. What it shows is that white murderers are more likely to get the death penalty than black murderers.

    So what’s the alleged racism? That criminals who murder whites are more likely to get the death penalty than those who murder blacks. Of course all that overlooks the fact that jurors are more likely to sentence certain kinds of murderers to death: murderers who rape or torture their victims, for example, especially if those victims are very young or complete strangers. It probably also overlooks that blacks who murder other blacks will probably, due to the racial composition of their jurisdiction, end up with a jury largely or completely composed of blacks, who tend to not be as supportive as whites are of the death penalty.

    And we wouldn’t want to point out that black murderers are far more likely to murder whites in that manner than they are to murder fellow blacks in such a way, or that whites tend not to murder blacks at all, would we?

    1) Certification exams -- and the use of them for government hiring.
    Certification exams where people can prove their competence at both general reading/writing/math competence and specific subject areas.
    And then critically the feds switch to using said exams rather than undergrad degrees for all their hiring.

    2) Free on-line courses.
    Create a platform that would host on-line courses. Leave the courses up to any university professors--or anyone else for that matter--that wants to create them. But compensation would come only from actual usage--through to the end--by students, and taking an associated exam.
    In lieu of student loans, students--all citizens--would have a "credit" they could spend on at this on-line "university". But it wouldn't be limited to "university" either, technical, skill-trades training--the knowledge base part at least--would be available as well.

    Platform would, of course, have a rating system where students could rate the quality/usefulness of the courses they'd taken, so platform itself would serve as a market.

    The most catastrophic disastrous mistake ever made by western civilization in with ts history was extending the franchise to women. Absolutely, it will eventually prove the literal death of the west and western man.

    That last blurb of yours, Steve, points out a very sick and tragic practice that nobody seems to give a damn about. Everybody seems to think that whoever happens to be in those types of max prisons deserves whatever's coming to him.

    It's a real case of cruel and unusual punishment, and even 10 years in a place like that can be pretty close to a death sentence. I would say that Papillon had it better down in French Guiana.   79. It is possible that higher levels of support for the death penalty in the South are attributable to the much closer proximity of Black & White neighborhoods, mentioned by MLK as the reason that the South would integrate quicker—post civil rights legislation.

    MLK thought Southern whites would adapt quicker due to living closer to Blacks, notwithstanding the small bands of Southern protestors exaggerated by the media post Brown V/S Board of Ed.—way back in 1954. The Yankees were still turning over busses in massive street protests to resist desegregation well into the mid Seventies, proving MLK right.

    My first Into to Media Narrative Hoaxing was not on Unz.com, but in a Black History class decades ago, where unedited films were shown of Southern & Northern school-desegregation protests, juxtaposed for scale.

    That was back in the day before school kids became frequent mass shooters, so the Yankee emotional hysteria over integrating their white kiddos with the Black kiddos was kind of telling.

    Fast forward 50 years past the 1964 civil rights legislation and after a two-term Black POTUS, and you have the same poor / Black & affluent / white neighborhoods, located in close proximity in the South.

    You also have a lot more integration of the middle and upper-middle-income neighborhoods, but that’s not the issue since upper-middle-class Blacks don’t commit a bunch of murders any more than upper-middle-class whites.

    The issue is an overall, increasingly violent society, where low-wage daycare workers with no stake in the kids’ outcome impart moral values to the kiddos, including to the often upper-middle-income, white school shooters. Low-wage daycare workers, elderly grandparents or NannyCam-surveilled babysitters raise the kids, whether that’s the every-couple-of-months white mass school shooters or the everyday Black gangland shooters.

    Goverment does it’s part to contain the mayhem by imprisoning a huge chunk of the poor, Black males after they turn 18 and sometimes before, holding the violence in abeyance in that way.

    And poor females are paid by goverment in increasing amounts per kid produced in single-breadwinner households, with Black and other minority females consuming a larger proportion of the pay-per-birth welfare. All single moms have to do is work part time, staying under the earned-income limits for the programs in that way, or they work temp jobs, skipping the welfare during months when they go over the programs’ earned-income limits, but still collecting the big, whopping refundable child tax credit—their “taxes.”

    This welfare rigging is creating a lot of misery and chaos for many non womb producers in the bottom 80%, specifically those struggling to live on earned-only income, but the evil system does supply Elites with a permanent pool of job seekers who need to work part time for low pay.

    Many of the young, male, older kids are so unsupervised by their pay-per-birth moms who get free food, free housing, monthly cash assistance, free electricity and up to $6,431 in refundable child tax credit cash that they walk around the streets at night, just hanging out (or whatever).

    Ummm, ya, Southerners worry about the increased possibility of being a victim of violence, especially since Blacks commit such a stunning percentage of the murders and because of the close proximity to their neighborhoods, whereas the Northern & coastal Woke Elite control for this fear by pumping up real estate values so high that no poor person could get within 100 miles of their feminist Barbie-princess palaces unless they were 1) the illegal alien help or 2) trespassing and, thus, subject to arrest.

    Southerners know that it’s gonna get worse with any mass release of prisoners, even though mass incarceration is a majorly stain on the concept of liberty.

    A “virtuous people” capable of sustaining a free Republic would not have 5% of the world’s population and 25% of its prisoners.

    Mostly womb-less males and thus ineligible for the smorgasbord of womb-productivity-based welfare products, when they are released, the former prisoners will live with their grandmas or their moms, while the mothers of their kids live in “independent” households financed by Uncle Sam. In the South, even if you live in a cathedral-ceiling home in a posh zip code, they can be right down the street.

    These crimes and murders took place in 1980 and slightly before. The US was the wild west then compared to Sweden. And white murderous criminality (in USA) was still high, showing high levels of testosterone. This has subsided.

    1) Certification exams -- and the use of them for government hiring.
    Certification exams where people can prove their competence at both general reading/writing/math competence and specific subject areas.
    And then critically the feds switch to using said exams rather than undergrad degrees for all their hiring.

    2) Free on-line courses.
    Create a platform that would host on-line courses. Leave the courses up to any university professors--or anyone else for that matter--that wants to create them. But compensation would come only from actual usage--through to the end--by students, and taking an associated exam.
    In lieu of student loans, students--all citizens--would have a "credit" they could spend on at this on-line "university". But it wouldn't be limited to "university" either, technical, skill-trades training--the knowledge base part at least--would be available as well.

    Platform would, of course, have a rating system where students could rate the quality/usefulness of the courses they'd taken, so platform itself would serve as a market.

    No, No, No. What you are proposing would collapse the house of cards that employs millions of Americans.

    Unemployment would go through the roof and any politician connected with such a thing would be history.

    The NFL and NBA would be forced to recruit from the general public. Or create a farm system like baseball does.

    Saturday afternoon football would cease across America. Trillions of dollars would never be spent on Chinese made college related sports junk. And gambling. And bragging rights.

    Economic disaster. People would have money but nothing to spend it on. No football tickets, no new stadiums.

    Medical research would be left to the pharmaceutical companies.

    Unlike blacks--to be fair "a lot of blacks"--i have no racial loyalty to white criminals murders, rapists, robbers, thugs. Kill 'em all--i'm fine with that. I believe in good racial hygenie. Got some white slime--get some bleach and kill it.

    In a proper "nation"--rather than just a state, controlling a piece of territory--people who don't want to conform to the cultural norms and values of the nation, should leave, be tossed out or killed. That's how it worked back in the day. (Didn't like it--hike on over that hill.)
