Study shows Black offenders more likely to get federal life sentences

Black Americans are more likely to get federal life sentences than whites or Latinos, a new study has found.
Why it matters: The analysis, published recently in Criminology, further illustrates the racial disparities of federal sentencing at a time when advocates are pushing for sentencing reforms for nonviolent offenders.
Details: An examination of more than 366,000 offenders convicted and sentenced in 90 federal district courts from 2010 to 2017 found racial disparities around life sentences targeting Black offenders. (The research excluded offenses related to immigration law.)
More than 4,800 of all offenders were eligible for life imprisonment — and almost 1,200 received life sentences, the study found.
Black offenders accounted for fewer than a third of all cases but constituted nearly half of those eligible for life sentences.
White offenders accounted for more than a third of all cases but constituted less than a quarter of those eligible for life sentences.
Between the lines: Hispanic offenders were more likely to be eligible for life sentences than white offenders, yet half as likely as Black offenders to receive life sentences.

This graph would be easier to read if the first column were the last column. What it is saying that is that out of some pool of offenders, presumably those committing crimes for which a life sentence is at least theoretical possibility, Hispanics were 50% more likely and blacks 80% more likely than whites to be eligible for a life sentence under sentencing guidelines. But out of that smaller sifted pool, blacks only were sentenced 10% more likely to get a life sentence and Hispanics 50% less likely to be given a life sentence.
Overall, out of those who were convicted of crimes for which a life sentence is a possibility, Hispanics were 20% less likely than whites to wind up with a life sentence (1.5 * 0.5 = 0.75). Weirdly, the math doesn’t seem right for blacks: 1.8 * 1.1 = 1.98, but the graphs says 1.6.
Just why wasn’t clear — and how Hispanics identified themselves prior to changes with the 2020 census may have affected results.
Researchers suggest race and ethnicity are indirectly related to modes of conviction, mandatory minimums and departures from sentencing guidelines.
What they’re saying: “Two out of three people serving life terms are defendants of color, and some believe that life sentences are fraught with racial bias,” Brian D. Johnson, a University of Maryland criminology and criminal justice professor who led the study, said in a statement.
Alternative headline: “Study shows Black offenders more likely to commit more horrific crimes deserving life sentences”
… Don’t forget: The First Step Act, signed by President Trump, reduced some federal sentences and gave judges more sentencing flexibility.
The bill led to the release of at least 3,000 inmates by the end of 2019, according to NBC News.
Axios reported that Trump later told people he regretted following some of son-in-law and senior adviser Jared Kushner’s political advice on criminal justice reform.
And the murder rate fell like a stone in 2020. Oh, wait … Never mind.

Unlike the death penalty, though, almost no empirical work has examined the decision to impose life imprisonment. The current study analyzes several years of recent federal sentencing data (FY2010–FY2017) to investigate underlying sources of racial disparity in life without parole sentences. The analysis reveals disparities in who receives life imprisonment, but it finds these differences are attributable mostly to indirect mechanisms built into the federal sentencing system, such as the mode of conviction, mandatory minimums, and guidelines departures.
“Indirect mechanisms” sound like Systemic Racism.
Both Black and Hispanic offenders are more likely to be eligible for life sentences under the federal guidelines, but conditional on being eligible, they are not more likely to receive life sentences.
Huh? That’s seems to be Off-Narrative. We wouldn’t want Ms. Kimchi to get cancelled.

A homeless man spent nine days “terrorizing downtown” with a series of violent attacks on women that culminated with the stabbing death of a Maryland woman last weekend, prosecutors said
Tony L. Robinson, 41, was ordered held without bail by Judge Charles Beach after prosecutors laid out allegations to support charges of first-degree murder, robbery, and multiple counts of aggravated battery on Saturday afternoon.
Beach, reflecting on Assistant State’s Attorney James Murphy’s assertion that Robinson was “terrorizing” the area, said, “I don’t think that’s an unfair statement in any way, shape, or form.”
“Frankly, it is an act of terrorism on the community,” Beach said, calling the allegations an “ongoing nine-day terrorization of individuals who are visiting our city, or working around the Loop area, or living in the Loop area.”
Police arrested Robinson Thursday afternoon on the 300 block of South Lower Wacker Drive, where he lived in a tent, according to Murphy and police records. Officers who executed a search warrant on the tent recovered a sock filled with rocks, two knives, and other items, Murphy said.
Wacker Drive is the magnificent street in Chicago’s Loop that follows the right left bank of the Chicago River around. (The Chicago River used to flow into Lake Michigan, but it’s direction was reversed over a century ago.) I worked from 1991-1993 in an office building at 300 South Upper Wacker Drive.
The giant Sears Tower (now the Willis Tower) is diagonally across Wacker from my old office. Tons of tourists, including Amish and/or Mennonites laying over at the nearby Greyhound bus station, walk by to go to the top of the Sears Tower. I was under the impression back then that the Amish refuse to use all modern technology so I assumed they must walk up to the 109th floor, but I was mistaken about the Amish and their actually more instrumental relationship to modern tech.
Underneath Upper Wacker, Lower Wacker, where the murderer camped out, is more Brutalist Ominous. It made a notable setting for parts of Christopher Nolan’s Batman Begins.
Anat Kimchi, a 31-year-old criminal justice doctoral candidate from Maryland, was walking on the 400 block of South Wacker when Robinson grabbed her from behind and overhand stabbed her in the neck and upper back with a knife, Murphy said.
A witness who saw the attack from a nearby park thought Robinson was trying to rob Kimchi, but Robinson only got away with her sweater, Murphy continued. The witness briefly confronted Robinson but backed off when Robinson threatened him, Murphy said. The witness then went to Kimchi’s side and held her until paramedics arrived.
DNA material from a shirt the attacker discarded near the murder scene matches Robinson, Murphy said. Surveillance video allegedly shows Robinson running with a knife in his hand after the murder and throwing an object into the Chicago River. …
Robinson is also charged with violently beating a 50-year-old tourist near her Loop hotel as she walked to get coffee. The woman, who was visiting from St. Louis for a baseball game, told police that a man confronted her as she walked on the first block of East Ida B. Wells and asked if she was following him around 7:14 a.m. on June 13.
The woman said, “no,” and tried to keep walking, but the man struck her in the head with a hard object. She told police it felt like she had been struck with a concrete block, Murphy said. …
Murphy suggested Robinson is also responsible for violently beating a 25-year-old woman with an object on the 500 block of South Franklin around 9:30 p.m. on June 10. CWBChicago previously reported that the woman’s injuries were so severe, fire department personnel thought she’d been shot in the head.
… Robinson has a criminal history in St. Clair County for burglary and other crimes. CWBChicago reported Friday that his Cook County record only includes misdemeanor allegations….
Mr. Robinson just might have earned himself a life without parole sentence …

Federal criminal sentencing is highly deterministic. Your crime gives you an offense level. There are upward (did you use a gun, did you victimize a child or federal judge) and downward (did you plead guilty) deviations. Then they calculate your offender category based on criminal history. They use those two numbers to pick a guideline sentencing range from a table. If the judge wants to deviate from the guidelines, he has to explain why, and those deviations are usually overturned on appeal.

If the victim refuses to cooperate voluntarily it can be difficult to make a case. With regard to the linked story the prosecutor would have to force the victim to show up for the trial, be prepared to grant him immunity if he pled the fifth and then hope the victim doesn't say something like he was so high on drugs at the time that he doesn't really remember what happened. Or, I want it applied everywhere. Affirmative action for NAMs hurts gentile whites more than jews. This stands to reason. Jews have higher SAT scores and (probably) grades than Gentile whites. The students most affected by AA are disproportionally non-Jewish. Either AA should be illegal or Jews need to share the burden of affirmative action.
Come to think of it, we are gaslighted that no one is harmed by AA. So Jews, being the biggest supporters of AA, should bear the entire burden that is not a burden? Right? They would not be harmed statistically. If they don’t get into Harvard, then they can go to Princeton.
This is not a quota system for Jewish people. I’m not saying that Jews are x% of the population, so they should only be x% of students at selective schools. I’m just saying that Jews, who are the biggest boosters of AA, should not be 0% of the applicants denied admission to make room for the dumbs of the favored races.
What ever happened to conservatives and R-words who opposed affirmative action? Have the given that up in their Quixotic quest for 6% of the black vote (that’d be a 20% increase!) or have the ceded the universities to the left? I remember Michigan’s (Minnesota’s?) AA ban in the nineties. I was at Reed at the time, and a woman from some uni there came to give a talk. She was very clear that the academic powers that be really did not want to obey that law. I was young and idealistic at the time. I was shocked that educated professionals would work hard to undermine the law.
College admission is much more opaque and the applicants much less protected by law than job applicants. Though I think employers should have access to applicants SAT/ACT/GRE/MCAT/DAT scores. Hell, if we are going to have liberal fascism (I thought that was a stupid term, and did not read he book) we should have the best-run fascist state we can. The people in charge and the media have not covered themselves in glory throughout the COVID crisis. I think it’s because they aren’t very smart. Does it much matter how bright the top man is if his underlings are not bright enough to execute?
I think that’s the situation for the Dems. Of the coalition of the fringes, white women, gay men, and Jews provide the brains. Hispanics and blacks? Lol, nope. WWJ - I need a “D” word for gays (not d*ke, thats’s a slur) and then we get WWJD as an acronym for the smartyparty actual smarties. All three of those groups are better with words than they are with the physical world. Much like institutions and traditions evolving to mitigate white men’s flaws, foibles, and fuckups, these systems designed and evolved by and for white men do not work super-well for people with significantly different ways of thinking, like WWJG.
Take critical race theory and the schools. Probably because children require a lot of work from at least one parent, women are heavily on the nurture side of nature and nurture. So they are not willing to concede that some kids are naturally better at math than others. Mix that with sex and race differences in ability and interests, and the educrats in Cali eliminated advanced math in high school. Math hit every sore spot - at the high end (at minimum) boys are better than girls, mathematical ability follows Rushton’s rule, so Asians’ success disproves white juju keeping blacks dumb, smart kids (regardless of race) are a lot better at math, and the educrat females themselves were particularly bad at math, else they would not be educrats. There is no way they would tolerate that, so now every California public school student does the same math as everyone else in the state in their grade. I new some kids in high school who could sophomores who could learn math as fast as it could be taught. They did not require re-explanation or review, they could do integration by parts in their heads! I was definitely not one of them.
Y’know, in some ways tracking kids is kinder than putting everyone in the same class. Put everyone in the same class, and then the dumbs see several times an hour that their are kids way smarter than they are. Track them and they don’t get constantly humiliated.
That would not have happened if there were cultural practices and beliefs that mitigated some of women’s cognitive and psychologically differences- besides the Old Way - women out of the public sphere and women’s views and interests not mattering, except the few who were married to powerful men, and they have very different interests than everyone else. I’m only anti-feminist to the extent that feminism has promoted things that either intentionally or not led to dysgenic reproduction and fertility collapse. Hopefully work from home will allow smart women to have an easier time having work success and rising status and babies. One can dream.

Decoding the statistics-speak: the probability of actually getting a life sentence, given that you are eligible for one (the “conditional on being eligible” bit) is not significantly greater for blacks and Hispanics than for whites (in this situation, the data actually show Hispanics are half as likely than whites to get life, and blacks just 10% more likely to get life, but the 10% increased likelihood isn’t statistically significant).

But how does “theoretical possibility” differ from “eligible for a life sentence under sentencing guidelines”?
Are they saying that you can get a life sentence via two routes: (1) sentencing guidelines, or (2) judges who ignore sentencing guidelines and give blacks life sentences anyway? And if so, is this illegal and could it be appealed? Is so, why isn’t it? If not, then what are the factors that judges can and do consider when throwing the book at blacks, and are those factors reasonable?

I would really like the now “conservative” Supreme Court to take some case – perhaps of the Mexican felon is not to be prosecuted for illegal re-entry, because the judge said the people who made the law did not think highly of Mexicans – and rule that “disparate impact” is not a thing that exists in American law and justice. Showing a difference does not show discrimination. It could be due to different behaviors by individuals in the two groups.
Or, I want it applied everywhere. Affirmative action for NAMs hurts gentile whites more than jews. This stands to reason. Jews have higher SAT scores and (probably) grades than Gentile whites. The students most affected by AA are disproportionally non-Jewish. Either AA should be illegal or Jews need to share the burden of affirmative action.
Come to think of it, we are gaslighted that no one is harmed by AA. So Jews, being the biggest supporters of AA, should bear the entire burden that is not a burden? Right? They would not be harmed statistically. If they don’t get into Harvard, then they can go to Princeton.

The people in charge and the media have not covered themselves in glory throughout the COVID crisis. I think it’s because they aren’t very smart. If you apply AA quotas to Jews so that they are no more than 2% of any existing top school, it will not affect Jews in the least. Why? They will immediately make their own better schools. They have the funds. Diplomas from the Ivy League do not confer intelligence. And if you do not let the Jews go to school at all, they will go into business. I might think that this would indicate that the professor is (almost certainly secretly) un-Woke and realizes what a crock this is, but it’s more likely he- and probably even her, in her last minutes- is thinking, “Oh, if only her work had succeeded this wouldn’t have happened.” Delusion can be powerful.
This may come as a shock, but *not all Jews think alike.* And not all are out for the best for the Jewish people. We recently had a Federal judge rule that an illegal immigrant who was convicted of a crime shouldn’t be deported, because most of those deported are Hispanic.
It is ironic in that Kimchi’s death might prevent her paper from being cited by a left/liberal judge looking for a rationale to reduce the punishment of a criminal. Consider this alternate reality: Kimchi didn’t get murdered. A left/liberal judge goes lighter on the punishment on a criminal, citing Kimchi’s paper. That criminal, after serving his sentence, is released and commits new crimes.

Her genes are probably just fine. Absent her pickling in minoritarian propaganda, she'd probably have made a good mom. Perhaps a bit tedious at the PTA meetings, but raising smart kids--future positive.
But she needed better advice, better guidance. Parents who'd tell her, this stuff is bullshit. Don't make a career out of telling lies about "systemic racism" to explain black crime. Other Jews and good whites spew enough of that nonsense. Find something productive to do. And most importantly find a young man, get married, start a family--the important stuff of life that will really give your life meaning and happiness.

My wife and I used to get a few romantic overnight getaways a year in the River North area. We stopped about 5 years ago. I also used to take my older daughter to a few Cubs games each season but stopped after I was “bumped into” by a young honor student on Waveland Ave.

If the victim refuses to cooperate voluntarily it can be difficult to make a case. With regard to the linked story the prosecutor would have to force the victim to show up for the trial, be prepared to grant him immunity if he pled the fifth and then hope the victim doesn't say something like he was so high on drugs at the time that he doesn't really remember what happened. It can be done and sometimes is in domestic abuse situations but prosecutors tend to prefer easy cases.Replies: @Paperback Writer

There is an incredible amount of overlap between most state crimes and federal crimes. For example, wire fraud is literally just using the wires (i.e. a cell phone, the internet) while you deprive someone of property with a false statement. The joke my criminal law professor told us in law school is that if you crank call a friend, telling them that there’s going to be a surprise birthday party at a location when there really isn’t, the telephone call is a sufficient wires hook for federal jurisdiction, and the gas and time they expend driving to the location are sufficient deprivation of property for that crank call to be wire fraud. It’s really fucking stupid.
Another good example is Derek Chauvin. The cop who took a knee on George Floyd’s neck would have been indicted on federal civil rights charges because killing a black man in America counts as depriving someone of their civil liberties. Again, it’s all really fucking stupid.
Everyone thinks of federal crimes as more serious, or intricate racketeering / money laundering / bank heist type crimes. In reality, federal crimes are 90% a function of being on the feds’ radar. You can get on the feds’ radar by committing a crime they aggressively prosecute (e.g. illegal reentry, bank robbery, terrorism) or by being a somebody they want to crush beneath the weight of the machine.
