The abortion decision was costly to Republicans because a lot of white suburban women who are swing voters were against it.
But this is going to be cost free. The vast majority of Americans (who are not black) do not favor AA. Blacks already vote almost 100% Dem anyway.
Trump is right that we should thank him and his 3 appointments on the Court for this. People pretend that the Court operates on reasoning and interpreting the Constitution but in cases like this they vote purely on party lines. Of course the majority opinion is 100% correct but with a different Court they would have upheld it anyway. 25 years was just a “suggestion” – with the right majority on the Court it could have been extended for another 25 the way you renew a library book or Xi Jinping adds to his term in office.
Warren strikes me as smarter and generally less invested in this DIE crap than in old school "lift up all boats" progressivism. But people tend to make their brains conform to their political and social peers.

If I was a younger man, I’d suggest starting a betting pool on how long this decision will last. But since the Supremes–the black robed guys, not Mary, Flo and Diana–are on average younger than me, I can’t see much point.
But politics is downstream of demographics. And under the minoritarian raj, American politics and demographics just gets ever more embarrassing and depressing.

I do. The weaker state AA bans reduced unqualified black enrollment by about 75% at elite public colleges. And these weaker laws couldn’t be enforced in federal court.
Universities that resist will be at the butt end of federal injunctions and attorney fee awards.

The Court left an F150-sized hole for Applicants Of Color to weave a tale of how they overcame specific instances of racial discrimination through courage and determination and this magic-lawyer-language will be an instant dog whistle to wave them in over whites and Asians with better academic chops. Steve once noted that his view on hate crimes changed when he considered that it was important from a perspective of collective rights to have laws which tend to deter crimes which promote ethnic tensions.
This is essentially proto ethnic power-sharing logic. America first began to have some of this after the great wave with the setasides for Catholic and Jewish Supreme Court, ironically. However since it was merely assumed that WASPs or even Protestants in general would take care of themselves there was no explicit provision for them in this and so it is that in 2023 a court entirely consisting of members of Catholic and Jewish backgrounds has ruled the other major form of ethnic power-sharing, Affirmative Action unconstitutional, you’d think they’d get the joke but since nothing is in writing per the Catholic and Jewish only quotas on the Supreme Court, I suppose it isn’t in violation of any laws either.
Affirmative Action doesn’t exist because everyone thought that eventually the black proportion of students at elite US universities would match their proportion of 18-22 year olds. It exists because it was seen as an existential requirement for a larger than otherwise would be black undergrad population at elite schools in terms of serving the needs of the African America nation that came to be recognised after the mass political actions and riots of the 60s.
Affirmative Action and other set-asides for blacks were a cheapo way to keep some kind of political peace, De facto the US government and society recognises black America as a distinct thing which won political rights in the 60s but nobody told the constitution which was never amended to reflect this. More political autonomy for reservations is another form of this but is largely invisible outside certain places due to the much smaller numbers of Native Americans.
It will be interesting to see if this leads to more overt alienation towards the state among blacks, particularly middle and upper middle classes who provide the intellectuals and commentators who have the most to lose. Things may be muddled through with schools already anticipating this and beginning to end test-based metrics entirely with the result that little to no changes occur, at least for blacks. Questions may now be raised about the proportion of Asian and guess who is likely to be shoved aside to make room? Hint: It won’t be blacks or Jews.
The US only really formally recognises blacks and Native Americans as collectives with collective needs for Affirmative Action in order to give them greater access to the professional classes that compose the decision-making elite. Not having a voice in those rooms is pretty bad. Whites didn’t seem to really get this when the Jewish elite emerged but maybe they’ll get it when the Asian elite emerges, they’ll be less innately anti-white but they won’t be inclined to enact policy or make any effort to transform the economy to better suit whites or their collective interests.
Given the Native American like “deaths of despair” of whites as they are collectively displaced and disparaged, perhaps one day they will be recognised too and a true power-sharing paradigm that includes the biggest group too will come to pass. I’m not so sure right now this decision on it’s own is in the interests of whites, just look at Canadian universities.

They reversed “decades of settled law” when they reversed Plessy v. Ferguson, too. They reversed a few centuries of settled law when they made homosexuality legal and gave gays the right to wed (over the very recent objections of the majority of voters in ~35 states, including California).
One major difference is that, to my knowledge, nowhere anywhere ever has a majority of voters in any sizeable jurisdiction voted in favor of affirmative action. In fact it has seldom ever been enacted in anything remotely resembling a democratic setting. Usually an unelected board of regents or whatever, or an admissions office that has not consulted the will of the people at all.
The Left is pretty crafty at screaming MUH DEMOCRACY! when they have the numbers (good bye, electoral college); but plenty happy to scream BASIC HUMAN RIGHTS! when cramming unpopular programs (hello, mass immigration, et al) down our throats.

True enough, the Universities will reduce the weighting of the SATs and they are still permitted to discriminate based on economic background of applicants to increase the diversity of the student body. The SAT plans on assigning an adversity score which will capture students social and economic background, thus students will earn a higher diversity score if they attended bad schools or live in bad neighborhoods. Since race is not a factor the colleges will use the so-called “adversity score” to implement affirmative action without changing the demographics of the student body. They can discriminate against students from good schools so they will, as observed in some California state schools.

Yesterday’s ruling won’t end affirmative action. First, it only applies to one university and its students. And when California’s 1996 anti affirmative action proposition 209 was upheld by the courts nothing happened. Except that qualified Asians were admitted instead of grossly unqualified blacks and Hispanics. And the percentage of White students went down every year.

Relying on hardship will give more help to poor white gentiles, Jews, Asians, blacks, and Hispanics and give less help to well-off blacks and Hispanics. This strikes me as eminently fair (people aren’t personally responsible for their parents’ life circumstances either, after all) and is also something that white nationalists should support since it could reduce the Jewish percentage at US elite universities relative to gentile whites, especially those gentile whites who are smart but of relatively underprivileged backgrounds.

In the past, women separated from men, upper from the middle class, and race-ethnicities never mixed. Society seemed to run rather smoothly this way even though WWI devastated this social order in Europe.

Sotomayor is not so innumerate that she can’t understand that admissions is a zero sum game because the number of seats is (more or less) fixed, but she doesn’t care.
AA got started in an era where blacks (~12% of the population) were the only beneficiaries and had negligible enrollment at places like Harvard Law School (<1%). So if you put your thumb on the scale a little bit for blacks and doubled or tripled black enrollment from 5 guys to 10 or 15 in a class of 500+, the damage to whites was negligible and diffuse – you would never know which 5 or 10 white applicants didn't make the cut.
Now fast forward to current day America – the "minorities" are now the majority. Stanford is now 26% white and falling. Instead of just blacks you have competing minorities – some of whom (Latinos) qualify for AA and others of which (Asians) don't, for reasons that cannot be clearly articulated. (You are not allowed to say it is because Asians are naturally smarter than Latinos and you are hard pressed to conjure any difference in levels of discrimination if any – if anything, historically anti-Asian sentiment in America was stronger than anti-Latin sentiment). And maybe half of AA blacks at elite schools are African-African or Caribbean immigrants. If you are the child of Eritrean immigrants then you get AA but if your parents are from 50 miles away across the strait in Yemen, you don't. The whole system was unsustainable anyway.
Having a small set aside for an "oppressed" minority in a mostly white society was an act of charity but having a government sponsored and sanctioned system of ethnic set asides in a multi-cultural society is a recipe for eternal inter-ethnic strife as everyone tries to get their "fair" share of the pie. We are headed in that direction anyway but at the very least this tendency should be discouraged rather than more deeply entrenched into our legal structures.
The other huge problem w. AA that you alluded to is that it started out as charity. But then it immediately became like an admission of white guilt and an entitlement program. So it made blacks even more resentful and entitled. Even if they evade by cheating this is still a huge moral and legal victory against the grievance culture.

I think their PR agent was a dead guy surnamed Scalia. Conservatives gained faith in Catholics after Reagan put Scalia on the bench. Now you’re just being silly. Catholic overrepresentation is mostly just confined to the Supreme Court. In the US Senate, for example, there are 85 Christians. 27 of those are Catholic – roughly in line with the US population.
Jewish overrepresentation, meanwhile, is amazingly commonplace in positions of power. 9 Jews in the US Senate (including the majority leader), 5 in Biden’s cabinet (including Chief of Staff (current and former) and 4 of the 5 most powerful departments (Justice, State, Treasury & Homeland Security).
Right – because people here never complain about too much immigration. It’s practically never even mentioned.
The problem with Latinos isn’t that they’re Catholic. White Catholics are pretty much indistinguishable from White Protestants on most metrics. You can’t discount the moral aspects of the law. The legality of AA was like a societal concession that white people are bad and their rights don’t count. This only made blacks feel more entitled and resentful (repeating my comment to Jack D here). The elites’ self-conception as the virtuous people is fatally wounded when they have to sneak around violating the law (as will be obvious to everyone).
It’s also likely they will destroy their (intellectual) elite status by dumping tests and admitting practically by random, like the UC system has done. If Harvard is eventually recognized as a woke font of mediocrity, it loses it’s power. I’d call that a win.
Finally, this opens the door to some schools that didn’t really want to do AA but felt they had to. Now they have an excuse to go full merit. If some slightly less prestigious school out there goes against the grain by going full test scores they will blow past the Ivies in IQ. It may take the Ivies down a notch to try to explain why “their students may be smarter but ours are better because . . . uh, . . . ”
And what schools are these?

The original civil rights and AA stuff had some political traction in America from Western Christian “we’re all in this together”ism. Some sense of shame and desire to be fair. MLK played directly to this in his speechifying. The original “lookout and be sure you’re giving talented black guys a shot” AA was in this vein. We haven’t been fair to these folks and need to bring ’em on board if we’re all doing this together. And sort of like raising a kid, you’re helping them along and don’t hold them to the same standards. AA was JV. Coach ’em up to varsity. Not a permanent–entitlement–parking spot.
My quibble here is that ethnic political allocation is just per-spec once you are multi-ethnic in a democracy. In old imperial orders–that you seem to like–the general program is “pay your taxes, don’t cause trouble and STFU”. Maybe the emperor doles out some special privileges. “Hey the Jews get to middle man or tax farm and your peasants don’t to organize and chase ’em outta town”.
But as soon as you have any sort of democracy in a multi-ethic polity you’re going to have ethnic squabbling. That’s isn’t some sort of failure of the society … it’s baked in. Thanks. My thoughts exactly. In the new multicultural America, selective discrimination is harder to justify. AA, though always irrational, was a well intentioned band aid that was just (barely) workable in historic America before the non-White migration became overwhelming. Whites are now just another ethnic group (perhaps two ethnic groups: ‘Patriots’ and ‘Sh$tlibs’). Ending AA keeps the empire limping along for at least several more decades until divide and rule (*cough* – I mean ‘Diversity’) makes a unified polity impossible.

Regarding Indian ancestry, Warren is hoist by her own petard in multiple ways: first, as noted by others, her percentage of Indian ancestry is tiny, far less than one would expect from a typical Oklahoman; but second, the tribe she claimed ancestry from – the Cherokee – don’t care about blood quantum anyway.
To be a Cherokee, or a member of one of the other Five Civilized Tribes, you must show descent from someone on the Dawes Rolls, which were the official lists of all recognized members of the five tribes of Indian Territory (now the state of Oklahoma) – Cherokee, Creek, Choctaw, Chickasaw, and Seminole. You can’t just say, “my great-great grandfather was a Cherokee, honest!”; you have to identify someone on the Dawes Rolls, then provide detailed documentation (birth certificates, marriage licenses, etc.) showing how you are descended. If there’s someone in your family tree that’s not on the Dawes Rolls but has already done that paperwork and been recognized as a tribal citizen, then you just have to go back to that person, but the documentation still must be solid.

The common law developed in early-medieval Catholic England, and was first organized into a uniform system by Henry II, who–despite that little awkwardness with Thomas a Becket–was a Catholic. Catholic bishops like Herbert Walter and Stephen Langton wrote some of the earliest commentaries on the common law. Anglo-Saxon common law is a good deal more Catholic in origins than it is Protestant.
