University of North Carolina Can Keep Affirmative Action, Judge Rules

Students for Fair Admissions vowed to immediately appeal in a case that appears destined for the Supreme Court.

The University of North Carolina at Chapel Hill may continue using race as a factor in its admissions process, a federal judge ruled on Monday, rejecting the argument of a conservative nonprofit legal group that is attempting to dismantle college affirmative action policies across the country.

In her ruling, Judge Loretta C. Biggs said that the school’s use of race in deciding which students to admit was narrowly tailored, and that it had made an effort to consider race-neutral alternatives.

Basically, there are no race-neutral alternatives to assembling an elite but diverse freshman class.

“U.N.C. has met its burden in demonstrating that it has a genuine and compelling interest in achieving the educational benefits of diversity,” said Judge Biggs of the U.S. District Court for the Middle District of North Carolina. She added that the “educational benefits sought by the university are concrete and measurable and are not elusory and amorphous.”

The article does not contain a link to measurable concrete proof of this assertion.

The Supreme Court ruled in 2003 that it’s OK for state universities to violate the Equal Protection clause in their college admissions systems because they aren’t doing it to benefit blacks, but instead are doing it to benefit whites by making sure there are a critical mass of black students introducing all their great Black Ideas into classroom discussions. That’s why American college campuses in 2021 are so famous for their intellectually stratospheric levels of free-wheeling no-holds-barred classroom debates over the great issues of our time.

By the way, I was not familiar with the word “elusory.” But both of its definitions are apt in this case:

  • avoiding the issue; evasive elusory arguments
  • difficult to grasp mentally; elusive elusory ideas

“Evasive and elusive” basically sums up the last 53 years of jurisprudential logic on college admissions.

The plaintiff, a group called Students for Fair Admissions, vowed to immediately appeal, and the case appeared destined for the Supreme Court, which is currently considering whether to hear a similar case against Harvard University.

The legal standard governing racial considerations in admissions was established in 2003, when the Supreme Court ruled that a University of Michigan Law School admissions program did not violate the Constitution by giving special consideration to racial minorities, so long as it took into account other factors on an individual basis.

This argument never ever made any sense, but it seems to sufficiently confuse and thus reassure white people.

In a statement, Beth Keith, an associate vice chancellor at U.N.C., said: “This decision makes clear that the university’s holistic admissions approach is lawful. We evaluate each student in a deliberate and thoughtful way, appreciating individual strengths, talents and contributions to a vibrant campus community where students from all backgrounds can excel and thrive.”

It’s holistic.

Granted, you’d never get away with this kind of stupidity in an online debate about how to select the most promising baseball players. But Americans are extremely dull-witted about anything involving racial statistics.

I’m guessing that some people assume that if blacks tend to be less book-smart, then that just proves they must have higher grades or do more extracurriculars or something. But I’ve never heard this idea enunciated.

Overall, I think mostly Americans come back with a big DOES NOT COMPUTE message when any idea that might violate their protective stupidity impinges on their consciousness.

Students for Fair Admissions had argued that the University of North Carolina considered race in an unlawful, heavy-handed way, tilting the scales in favor of underrepresented minorities, so much so that a mathematical model was able to predict with 90 percent accuracy whether a student would be admitted.

The school acknowledged using race as a criteria in admissions decisions — but not racial quotas

The Bakke Decision of the 1970s held that you cannot use “racial quotas” … unless you call them “racial goals.” Then, you’re good.

— in order to increase campus diversity at North Carolina’s flagship public university. While race can be a “plus” for a given applicant, the university said, it is considered only in the context of “everything else known about an applicant.”

And that makes everything totally different for reasons. Nobody has ever explained the reasons, but isn’t it obvious that if the reasons, whatever they are, are hard to understand, then that just proves they must be true. All smart people know that.

In testimony in a bench trial last fall, Steve Farmer, who was then North Carolina’s provost for enrollment and undergraduate admissions, said the university considered race only as part of a process that takes into account grades, test scores, extracurricular activities, socioeconomic status and family background.

See, it’s all very complicated which proves it’s honest. As we all know, the harder a process is to understand, the less chance the people running the process are violating any rules, such as the Constitution. Occam’s Butterknife proves that.

    Ideally, you have a one-people nation and don't have these issues at all. Unfortunately we are headed in the other direction.

    But if you are stuck with doing political allocation, then it is much better--less cancerous--to do it openly with less lying about what's going on and why. And quotas allow all groups to get in on the scrum and get themselves whatever goodies are on offer.


    Boiled down the kritocracy has installed this kludgy system of "affirmative action" because
    -- Jews don't want quotas on them (they don't want to be quotaed down)
    but
    -- Blacks/buffer "oppression" is the sine qua non of the delegitimization of the white gentiles who built America, their right to be a nation.

    The whole "affirmative action" deal keeps blacks on side with the super-state parasite party, and continually requires retelling the saga of oppression, oppression, oppression. "Oppression" is the mother's milk of minoritarianism.

    Because — on average — the IQ of US blacks is about a standard deviation lower than that of whites.

    Also, in terms of the big five CANOE personality traits (Conscientiousness, Agreeableness, Neuroticism, Openness and Extroversion) blacks score lower — on average — on contentiousness than do whites; that is they don't apply themselves as much.

    Individual whites who score lower than the white group average on IQ and conscientiousness, don't get admitted on lower standards quotas, so what's the argument for blacks?

    Traditional US Blacks have enjoyed 50 years of racist discrimination in their favor for jobs and university admissions. They loudly whine that's not sufficient to overcome their stupidity. It isn't.

    This particular case is one of a racist judge defying US law as racist judges have for the last 50 years. It won't magically make traditional US Blacks intelligent. Judicial corruption has failed at that for 50 years and will always fail. You can't fix stupid just because you're a lawyer and lie you're honest.

    One female Democrat Governor has openly said that traditional US Blacks are too stupid to learn to read, write or do mathematics and the only thing to do is to make reading, writing and maths irrelevant. I think her solution is extremely stupid but at least she sees traditional US Blacks for what they are. She'll continue to lie about that but her actions speak louder than her words.

    This is where CRT comes in. Whites inherently have an advantage due to their race, according to the doctrine, so using racial preferences for blacks just brings them up to the starting line.

    And don't think this is just about college admissions, either. You can apply this "reasoning" for any gov't job or contract. The cops and judges can use it for arrests and sentencing. All of society, for that matter, should be using it in every decision. In this way it becomes like Christianity, in that you're always seeking to please and honor God in every area of life. And it is impossible to please God (racial equity) without faith.

    In theory — theory — it shouldn't be a problem if it isn't "our" country anymore. Without the immigration disaster and the federal government's heavy-handed campaign for population replacement, our country could include a limited minority of nonwhites. Conceivably they would contribute more than taco stands. I'm not sure what, but a strong majority of whites might benefit from interaction with some other cultures (not all).

    That vision is irrelevant now. The nonwhite "minorities" are a de facto majority, with government, corporate and private institutions acting as a force multiplier on their behalf. We are a target. We can depend no longer on the rule of law or the Constitution. We have no future, except for one we create.

  14. Several decades ago, the UNC system shifted some attractive programs to their historically black schools to integrate them, but nothing in the other direction that I remember. I wonder if those schools like losing their best prospective students to Chapel Hill.

    I’m a little shocked no other schools have had a big scandal over fake courses and grades for black jocks.

    This has been going on for over a century with white jocks. About forty years ago a prof told us of a Syracuse punter whose PE major consisted of punting.

    Long before that, ringer scandals were common. A notable instance was the 1907 edition of Clean, Old-Fashioned Hate, i.e., Georgia vs Georgia Tech. Both teams were accused of using ringers and were suspended. A hearing was held before their conference board. Coach Bull Whitney of Georgia was blacklisted, but Tech's coach, one John Heisman, skated.

    Well, yes.

    Whites need to stop enabling a system whose goal is to destroy us. On every form but the Census (from which they draw the numbers to establish the race quota) white people need to start identifying as something else - on job applications, loan applications, college applications, standardized tests, whatever. Identify as black or Hispanic. For the most part no one will ever question you.

    In most cases businesses and colleges just report what you marked on the application, to keep the government happy. By identifying yourself as a minority you're actually helping these institutions hit their quotas.

    I went to UNC. Michael Jordan was a year ahead of me. He was a freshman in the Fall of ‘81. Forty years ago. All that tokenism and ostracizing turned him into a real shrinking violet.

    IIRC, Bollinger was at U Mich and started the race suit that wound up at SCOTUS in 2003. There were some shenanigans with the judge selection at the appellate level that ensured a favorable outcome. From there, Bollinger failed his way up to Columbia president.     Whites need to stop enabling a system whose goal is to destroy us. On every form but the Census (from which they draw the numbers to establish the race quota) white people need to start identifying as something else – on job applications, loan applications, college applications, standardized tests, whatever. Identify as black or Hispanic. For the most part no one will ever question you.

    In most cases businesses and colleges just report what you marked on the application, to keep the government happy. By identifying yourself as a minority you’re actually helping these institutions hit their quotas.

    Several decades ago, the UNC system shifted some attractive programs to their historically black schools to integrate them, but nothing in the other direction that I remember. I wonder if those schools like losing their best prospective students to Chapel Hill.

    This has been going on for over a century with white jocks. About forty years ago a prof told us of a Syracuse punter whose PE major consisted of punting.

    Long before that, ringer scandals were common. A notable instance was the 1907 edition of Clean, Old-Fashioned Hate, i.e., Georgia vs Georgia Tech. Both teams were accused of using ringers and were suspended. A hearing was held before their conference board. Coach Bull Whitney of Georgia was blacklisted, but Tech’s coach, one John Heisman, skated.

    In theory — theory — it shouldn’t be a problem if it isn’t “our” country anymore. Without the immigration disaster and the federal government’s heavy-handed campaign for population replacement, our country could include a limited minority of nonwhites. Conceivably they would contribute more than taco stands. I’m not sure what, but a strong majority of whites might benefit from interaction with some other cultures (not all).

    That vision is irrelevant now. The nonwhite “minorities” are a de facto majority, with government, corporate and private institutions acting as a force multiplier on their behalf. We are a target. We can depend no longer on the rule of law or the Constitution. We have no future, except for one we create.

    Predictably, nothing. Madison PD spent two months investigating and released detailed report (with videos) that concluded that they are unable to find any evidence of the incident to have occurred. The released videos make it 100% obvious that she lied but MPD did not find courage to say that. Not a word was ever heard from FBI that was supposedly also involved in investigation of this heinous crime.

    Hate hoaxes remain unpunished. Jussie Smollett's trial is scheduled for November 29. But nobody talks about the hate letter he likely sent to himself (that's a federal crime).

    Also, in terms of the big five CANOE personality traits (Conscientiousness, Agreeableness, Neuroticism, Openness and Extroversion) blacks score lower — on average — on contentiousness than do whites; that is they don’t apply themselves as much.

    Individual whites who score lower than the white group average on IQ and conscientiousness, don’t get admitted on lower standards quotas, so what’s the argument for blacks?

Given that genetic variation between Blacks and Whites causes most of the test-score gap (this has now been shown conclusively) perhaps the best solution is to just explicitly give Blacks 15 points extra on their applications, and return to rigorous score-based admission standards. Yes, admitted Blacks will perform more poorly than their White and Asian classmates, but this will be true in any case. To paraphrase Bill Clinton, it is genetic variation, stupid.

    Invoking the 14th amendment to eliminate explicit racial quotas/goals just make admission standards garbage for everyone, since the only system that can survive is near-random selection based on maximally noisy information (in order to hide the test score gap due to genetic variation between Blacks and Whites/Asians).

    It is genetic variation, stupid. Perhaps that is a good catchphrase.

  47. Overall, I think mostly Americans come back with a big DOES NOT COMPUTE message when any idea that might violate their protective stupidity impinges on their consciousness.

    I think that American White people are used to being screwed by AA after a half century of it and know there’s nothing they are going to be able to do about it (via lawful means). That might be because even real conservative politicians don’t do a thing about it and conservative pundits punt on this issue.

  48. I don’t know how many remember the Wainstein report issued in 2014 on fraudulent “paper” classes at UNC-CH. These were classes in the AF-AM department (Department of African American Studies) for which no educational activities were required (no tests, no papers, no appearance in class).

    I had assumed when I first heard that these classes were intended primarily to enhance the Tarheels’ already competitive basketball program, but it turned that that wasn’t the case.

  57. Everyone should remember that UNC does not have a school of engineering nor much of a school of natural sciences. The big question is whether the College of Business has separate, more selective admissions criteria than the university overall.

    Once again, everyone needs to member that more selective universities use fire walls to keep affirmative action admits away from difficult degree programs such as engineering or business.

    A statistics that a conservative governor or admission would require of all state universities or any private university that accepts state money should be the mean and SD for GPA and test scores for all ethnic/racial groups, graduation rates, and the distribution of majors of all ethnic groups.

    A university would look very hypocritical is public data showed that while arguing that white students need blacks students around to improve the educational experience while almost no blacks are majoring in the hard majors but are concentrated in African-American studies, sociology, and kinesiology.

I’m pretty confident that if you calculated the ratio of % of domestic students at various ultra-elite colleges to their % in the relevant age cohort of the US (call this ratio the ‘index” for each group), and you grouped by race, you would find that whites and blacks were not too far off an index of 1. Asians would be a lot higher than 1. My guess is that Hispanics would be somewhat below 1.

    But if you then sub-divided whites into Jews and gentiles, you would find that white gentiles have an index well below 1. White gentile males are likely the most under-represented group of comparable size on these campuses. But we never see this because of the way universities trumpet diversity statistics.

    Maybe we should look to knockout mice to see which neurological growth inhibitors can be knocked out and leave a viable mouse. From this set of genes, we can narrow the search for alleles with big positive effects on intelligence to these genes, and fine people with mutations that disable these genes, and see if they are smarter than siblings with the wildtype allele, or smarter than their GWAS-derived PGRS score.

    I vaguely remember that there is a “big science push to have a knockout mouse line for every gene. I have not searched yet, so maybe there are a lit of mouse genes where knocking them out improves maze performance?

    It would be nice if we had really good anatomical and physiological correlates of g. Then we could find things like, “knocking out gene A increases the number of cells in cruciferous palindrome. In h sapiens, an equivalent increase would raise IQ by blah points.

    Maybe there is a review article of all the genetic changes in mice that raise their equivalent of intelligence. Maybe we need a knockout line of every gene in a more human-like animal. Like if we had that for some species of monkey.

    All the more reason to do away with America's elite colleges. All have been taken over by a single way over represented tribe, not just in the student body but in faculty and admin. The Ivy League is downright TOXIC. Princeton has been shamed into greatly increasing their Jewish admits since this chart came out, amid all the howling of anti-Semitism, to the point where they now have a Jewish president.     Chief Judge Boyce F. Martin, Jr., of the U.S. Court of Appeals for the Sixth Circuit, reportedly used his administrative power to prevent an en banc review of the University of Michigan affirmative action case until two judges opposed to the policy became ineligible to vote on it.79

    On May 14, 2001, Martin received the petition for en banc review.80 At that point eleven judges were eligible to vote on it.81

    Martin delayed circulating the petition until October of that year, allegedly to prevent two anti-affirmative action judges from voting on the petition.82 In July, Judge Alan Norris, a Reagan appointee, took senior status.83

    The Sixth Circuit subsequently voted five to four to uphold the policy.84

    In a “Procedural Appendix,” dissenting Judge Danny Boggs wrote that the panel that considered this case was not constituted in conformity with [the local Sixth Circuit rule regarding en banc review] or any other rule.

    Under these circumstances, it is impossible to say what the result would have been had this case been handled in accordance with our long-established rules. The case might have been heard before a different panel, or before a different en banc court.85

    Two other judges castigated Judge Boggs’s dissent on the merits, and also because it might “undermine public confidence” in the court.86

    All the more reason to do away with America's elite colleges. All have been taken over by a single way over represented tribe, not just in the student body but in faculty and admin. The Ivy League is downright TOXIC. Princeton has been shamed into greatly increasing their Jewish admits since this chart came out, amid all the howling of anti-Semitism, to the point where they now have a Jewish president. In fact, the top 5 -- HYPSM -- now all have Jewish presidents, what a coincidence.

    America has no place to go but down as long as the Traitorous Eight remains atop the Education Industrial Complex. Time to burn them all to the ground. AA all the way, and anything less than 100% black is just hypocrisy!

    In Israel, your army unit is far more important than your college. The paratroops, the pilots, the Sayeret Matkal, the Navy Commandos etc. Those are the “Ivy League” units. Higher Education is for professional vocations in Israel. And it comes after the army. Your army unit and your rank and your combat service gives you prestige. Not college. And there is no AA to get into the best combat units.

  103. Overall, I think mostly Americans come back with a big DOES NOT COMPUTE message when any idea that might violate their protective stupidity impinges on their consciousness.

    Whites understand that advocating for fairness will be met with snarling hatred and retribution. So Whites pick their battles elsewhere – they build home equity through flight or gentrification – they indulge in leisure – they show up at work on time ready to contribute – they dote on family – they go to NC State or UNC Wilmington if shut out of the flagship UNC.
