The recent Tesla court case established that the latest going rate for paying off a black plaintiff for having to endure the agony of living in a multicultural society in which Hispanic, black, and perhaps white co-workers like hip-hop and thus use its vocabulary in your presence is \$137 million.

But is the dingy-looking Duluth charter school district as deep-pocketed as Elon Musk?

From NBC News:

Parents say Black students were beaten and spit on by white classmates

Black elementary and middle school students at Duluth Edison Charter Schools in Minnesota faced racist abuse, their parents allege in a lawsuit.

The suit, filed in April 2019, details a culture of racism at the Duluth Edison Charter Schools’ Raleigh, seen here, and North Star Academy campuses and school officials’ refusal to address it.

By Char Adams

A group of parents is suing a Minnesota school system alleging that their Black children faced racist bullying and discrimination from students and staff, including racist slurs and physical attacks. One teacher allegedly cut off a student’s dreadlock and threw it in the trash, the parents say.

In the annals of science fiction, there are some pretty imaginative predictions of what would cause the next big war. But did any sci-fi seer ever come up with World War Hair?

Kali Proctor, Katelyn Hansen, Roynetter Birgans and Desmond Gilbert are seeking monetary compensation and demanding systemic changes at Duluth Edison Charter Schools for the experiences their elementary and middle school-age children endured. …

“There’s been a lot of frustrated families in the Duluth Edison community,” said Rebekah Bailey, an attorney representing the parents. “The families in this case, all they really ever wanted is for their children to be treated fairly at school. They fought long and hard to remedy their individual situations as best they could through the system. This case was only filed when they exhausted those opportunities.”

Last month, at least two dozen nonprofit advocacy groups joined to file an amicus brief in support of the children and the lawsuit after an attorney for DECS requested to have the suit dismissed. The groups include the American Civil Liberties Union of Minnesota, the National Women’s Law Center, and many others.

Tim Sullivan, an attorney for DECS, told NBC News his office filed the request in August because “the facts gathered demonstrate that there is neither a factual nor legal basis to support the claims asserted against my client.”

The lawsuit said that white students bit, punched, kicked, pinched and spit on Black students and repeatedly called them the N-word. The white classmates also taunted them, calling them “negro” or “monkey” and telling them they “look like what’s inside a toilet.”

In 2017, a white student at North Star Academy threatened to stab a Black kindergartner in the eye with a screwdriver because she looked “different,” the lawsuit said. White students allegedly pinched and kicked the girl, who is biracial, on several occasions. And, during one bus ride to school, an older white student punched the girl so hard, she had a bruise on her rib, the suit states.

The girl’s father, Gilbert, approached school officials several times, demanding to meet and discuss the discrimination only to have staff avoid him and fail to “take any meaningful action,” according to the lawsuit.

In a statement to NBC News, Tammy Rackliffe, a spokesperson for DECS, declined to comment on the specific claims, but said the school system “strongly denies any allegation of discriminatory conduct and has vigorously defended itself against these false allegations.” …

There are 1,300 students at the two DECS locations, the school’s website states, and white students account for 78.6 percent of the school’s population, according to the most recent data from the U.S. Department of Educations’ Office for Civil Rights.

Something must be done about white students still making up a majority of charter school students in Duluth.

Duluth is a predominately white city, with Black residents accounting for 2.3 percent of the population, according to census data.

According to Raj Chetty’s immensely detailed findings, black parents with boys should move there.

According to the lawsuit, one Black student “was spit on so profusely by a white student that she had to change her clothes.”

“The white harassers received little to no punishment,” according to a statement from Public Justice, a nonprofit legal advocacy firm also representing the plaintiffs “And black and biracial students are punished more harshly and more regularly than their white peers.”

In other words, in the eyes of the adults observing these childish disputes, the black kids were the main troublemakers in these incidents. But, since we all know who are the Goodies (blacks) and who are the Baddies (whites), what various government employees observed with their own eyes in Duluth must be overridden by the racial biases of people who have never been within 200 miles of Duluth.

In Minnesota, Black students are disparately punished and suspended eight times as often as white students, according to the state’s Department of Human Rights.

As Dr. Prof. Ibram X. Kendi has proven, that can only happen due to racist policy.

The lawsuit says the school’s staff is more lenient with white students accused of harassment and school officials allegedly didn’t take parents’ concerns seriously. In an interview with Duluth News Tribune, Proctor said her son endured so much abuse that he told her he didn’t want to be Black anymore.

“It really breaks my heart because while all the other kids are dreaming of their life, he was dreaming of equality,” Proctor said, adding that she tried to work with the school to put an end to the harassment. “I wasn’t feeling that my voice was heard. They have policies and procedures in place, but I felt they really weren’t following through with what was being said.”

In other words, the school was doing exactly what it’s policies and procedures said it should do, but this black mom didn’t like the result.

The students discussed in the suit, who have all since left DECS, found support and comfort in Chrystal Gardner, then one of the school’s cultural liaisons, according to the complaint.

“Right away, I realized that there was an issue with the N-word being used so loosely at the school,” Gardner told the News Tribune. “A lot of the black students felt like if they even raised this concern, that nothing’s going to happen. And I sympathize with them and the parents who were offended as well, especially upon my bringing awareness of how hurtful that term is.”

Gardner repeatedly notified school administrators of the “racially hostile culture,” including an incident where students drew a swastika on a school bus, but nothing was ever done, according to the lawsuit. She recently settled her own lawsuit against DECS for wrongful termination, retaliation and discrimination after she was fired in June 2018 for complaining about the racist harassment the students’ experienced.

“At the school, I diligently provided support, resources, educational tools, and concepts from a cultural perspective,” Gardner told NBC News. “This was met with resistance, not always but more than enough. Nonetheless with valiant persistence, I aspired beyond my adverse experience at the school to assure the students of color had received an equitable and reasonable education deprived of interference to their success.”

Well, aren’t you wonderful?

This is one noose away from definitely being a hoax. How many kids ever spit on other kids? It is a racist trope of the 1950’s and 60’s. Yet, 5 y/o white kids from Minnesota are suppose to be acting like they are at the Woolworth in Greensboro, NC in 1960.

    Didn’t happen.

Alternatively, the teacher spotted one of the dreads shaped into a noose. When she overheard the student’s plan to go to a NASCAR race, she did what had to be done to protect Bubba Wallace.

By the way, kudos to NBC News for their thorough investigation of this case. A lesser news organization would have acted like stenographers for the payoff-hungry plaintiffs, while barely lifting a finger to present a more complete account.

  10. Under the theory of “aider and abettor,” an individual defendant who caused/permitted discrimination can be personally liable for damages IF the primary defendant (the school district) is found to have discriminated.
    Kind of a predicate, there.

You know, like a teacher or assistant principal.

Seen a bunch of these public school cases. Why, in nearly every case, do the plaintiffs not name as defendants the white administrators and teachers who aided & abetted this awful conduct?

Because that would set off a war with the Teacher’s Union, which is the last thing the Party wants.

  36. @Tony massey

In the 2010s, that would be because the earlier inverted form of the term, “colored people”, was by then considered a slur. Just like the UNCF and NWA, the NAACP was an organization whose name could not be uttered in full (a white news anchor was forced to apologize for saying it in an interview with the head of the NAACP).

But in the 2020s, you can’t call them “people of color” either. The hip new term “BIPOC” clearly implies that “people of color” does not include [b/B]lacks. But it’s merely a faux pas, not a slur (yet).

Honestly, after the whole OK-sign saga, I wouldn’t be surprised if 4chan trolls are incepting all the innovations in PC terminology these days.

This story about the boy in a dress that sexually attacked two girls in two different schools and the school and the school board’s lack of action and the board going after the one girl’s father at a school board meeting was also covered in the Daily Mail. I was thinking of it as I was reading this story.

I found this story, which was about white people, unbelievable but true and the many terrible stories I read about bullying in schools today beyond belief yet they are true. Kids kill themselves over bullying and last week there was a video of a kid getting attacked who then pulled out a gun and shot his bully and I thought well, who can be surprised?

I feel like I am not sure anymore what kids are capable of and what schools can turn a blind eye to. I do know I think most bullies are created at home through parents who aren’t paying attention to their kids or who are bullies themselves. All this intense and constant and terrible bullying that goes on today is telling us that our society must be in trouble. I hate the schools for ignoring it but I think they get sick of it and feel helpless.

The thought has crossed mind that there are laws that protect me from assault from an adult but nothing protects kids under 18 from being assaulted by another minor. Maybe we should allow teens at least to bring charges against each other. Of course it is opening up a can of worms but at least the bullies could be made accountable for their actions.

Sorry, Paperback Writer, I’m not entirely convinced. I’ve been there. I just did a few calculations based on numbers on this page‘s ’21 data. Drop down the “Duluth Place of Birth” link, and look at the Naturalized Citizens and Noncitizens** pie charts and the percentages on the right, Of the ~85,000 residents of Duluth, I get about about 540 from Africa. Drop down the “Duluth Population by Race”, and you get just under 2,000 of them.

OK, so that’s 1/4 of them. I really don’t think the White kids would give any trouble to American blacks, just based on average strength differences, but then, yeah, it’s likely this scumbroad Chrystal [sic] Gardner made 95% of this up anyway.

  57. @notsaying

I’m unclear what you mean, so I don’t want to jump to conclusions but…

Anything’s possible. Maybe there was bullying – kids can be quite cruel. Adults can be quite cruel. But after countless years of Smolletization I smell ordure.

I think it’s possible, as I said to someone else, that the kids threw around the word n8gga because that’s the style. Kids hear this and repeat mindlessly what they hear, and parents are so hands-off (in certain ways) and dense they don’t educate their kids as to how toxic this is. So maybe that happened.

    Otherwise, I’m skeptical.

There is a story about a black lady in Virginia Beach, who had a neighbor from hell, making the rounds, though. Her, I believe. She claims Neighbor From Hell was playing loud, racist music, monkey sounds, and blasting the N word from his stereo system. Because I have lived through neighbor from hell scenarios, I get the gut feeling she’s telling the truth. Also she seems normie & truthful and w/out agenda.

But I’ve also lived through bullying at school, and I’m not getting the ring of truth from the Duluth situation.

Yeah, thanks, PW. I should have read the thread first – I do that much of the time. You are right that those names don’t sound Somalian. What’s up with “Katelyn” though? That doesn’t even sound American black, and the last names don’t in particular.

With this being a charter school and those last names (could any have been adopted kids?) I’d think it’d be the more intelligent and well-off black parents who’d want to send their kids there to get away from the, well “N-words”. It’s sickening that they want to play this race game too.

I agree that this Gardner Cultural Liaison is a lying sack of shit. The only people calling each other “niggers” here would be the American blacks. I guess the Proctor, Hansen, Birgans, and Gilbert families didn’t like this. No wonder the one boy “didn’t want to be black.” Can’t say as I blame him.

BTW, I have been to Duluth many times, and the Somalians are all over the State of Minnesota, including there. I have a friend up the road a ways from there – they are not yet there anyway.

  59. Maybe Duluth native Bob Dylan will have a rally and fundraiser for the plaintiffs. This is what the City of Duluth gets for hiring a “cultural liaison”, which is just another value-added sinecure for alien hostiles in city government waiting for a shakedown opportunity. My wife and I noticed a black belt neighborhood surrounding downtown Duluth, which announces itself to those just passing through by the presence of Shaniquas and Shaquaviouses loitering on the block and lingering on the porch mid-afternoon. The neighborhood of brownstones would be heavily gentrified without these Minneapolis escapees. Apparently, even the long and bitter cold winters on Lake Superior are no deterrent to welfare migrants, who just need a safe place to party without the keeds getting shot.

What the hell are they doing in Duluth anyway? Working in taconite or medical research and technology? Duluth winters on the lake are even more severe than that of Minneapolis, brutal even.

Parents want Loudoun County, Va. school board to quit after accusation it covered up bathroom rape by ‘gender-fluid sex predator’

One of the protesting parents accused the board of covering up something that Superintendent Scott Ziegler claimed simply couldn’t happen – a sexual assault in a girls’ bathroom by a biologically male student, who was granted access to it because of their purported gender fluidity. The cover-up allegedly allowed the perpetrator to sexually assault another victim.

The alleged assault happened at the Stone Bridge High School on May 28. Elizabeth Lancaster, Smith’s attorney, said the perpetrator was charged with two counts of forcible sodomy, one count of anal sodomy, and one count of forcible fellatio.

The Loudoun County Sheriff’s Office confirmed that there was a sexual assault case at the school dated May 28 that “involved a thorough 2-month-long investigation” that led to an arrest. Law enforcement officials said the prosecution was still pending court proceedings.

  74. @Dacian Julien Soros

I’m assuming that there were some violent altercations, but that those incidents were triggered by Blacks bullying Whites (and Hispanics). Then when those Blacks received pushback, they whined to school admins, who naturally were not sympathetic to Black bullies.

Now it’s a national news story.

The default message to Whites (and sometimes other non-Blacks) is that they should just tolerate Black harassment and never fight back. Personally, I don’t think that’s healthy. Even Blacks would benefit if they understood that there were limits on what society would tolerate from them. Letting Blacks run wild (until they get injured, killed, or arrested) serves no one’s interest.

One takeaway is this. In the absence of pressure from the national media and the political elites, local Whites (even “nice” Midwestern liberals) are capable of dealing with Blacks and protecting their self-interest. It’s outside interference and subversion that’s destroying Whites, not any innate flaws.

  75. @notsaying

Maybe we should allow teens at least to bring charges against each other.

Political conservatives are big supporters of public education. They have no clue how to deal with the bullying pandemic; masks, maybe? They suggest that the way to deal with school shootings is to require unionized babysitters to CCW in school.

If we can’t a_p_e, then kids should be allowed to CCW. Their #2 (i.e. self-defense) rights don’t suspend just because the government drafts them into (often physically dangerous) public schools.

I don’t know, either. Certainly the accusations lawsuit sound extreme. But when we have school board members denying at public meetings that a boy in a dress raped one girl which left him free to attack another, the world is upside-down.

Another thing to consider is that no numbers were mentioned. It was probably the same handful of bullies doing all the worst things. You get a couple of bullies together and who knows what they cooked up in their nasty minds. If they had claimed a lot of kids were involved, I would have been a lot more skeptical myself. As for the n word, who knows? When black kids say it themselves, what are the other kids supposed to think?

  86. Chrystal Gardner is a piece of work.

She/It is suing her employer Accend for back pay after being let go for performance issues. The back pay is for days that she never accounted for in Accend’s system. Their policy is hours to be paid have to be accounted for. She refused to comply. They refused to pay.

    https://www.casemine.com/judgement/us/59145b2eadd7b049341dd6ce

Accend terminated Gardner’s employment on June 27, 2014. According to Accend CEO and President Michael Clevette, he met with Gardner “in late June relating to performance problems, complaints from clients, as well as services that were exceeding the clinically approved times, [and] a number of other issues relating to performance.” After their meeting, Clevette required Gardner to meet with her clinical supervisor on June 24. Gardner did not appear for the meeting and later “indicated to [Accend] that she . . . simply refused to attend the meeting.” Upon learning of her refusal to appear, Clevette terminated Gardner for misconduct. The same day, Accend disabled Gardner’s access to the electronic medical-records system through which counselors logged their time and services.

Gardner took the position that she was not required to complete the documentation of her services to be compensated for the hours between June 23 and June 27. In an mail to an Accend administrative assistant on July 9, 2014, Gardner stated that “with the request to complete documentation, I will not be performing or rendering additional services to Accend Services Inc.” Relying on Minn. Stat. § 181.13 (2014), she demanded a check for her hours from June 23 to June 27. Accend did not pay Gardner for this week.

A couple of generations ago, Minnesota was chock-full of truly decent, honorable people. So in fact were most of the adjacent states. Probably one reason why they became a focus of the Plot to Destroy America. The real one, that is, not the silly jewish propaganda novel.

The problem is that the type of people who produce continuous noise issues are 1) usually not amenable to polite, neighborly hints or suggestions and 2) likely to act out if the authorities are called in.

In the last three neighborhoods I’ve lived in, there was one house, and only one house, that caused problems. No one ever tried to intervene, to my knowledge, though we did commiserate a bit with one another.

But we were all white and civilized and simply not the type to cause trouble. It can certainly be argued that we should have, but no one should advance such an argument unless he’s in the position to suffer the repercussions.

In one case, we lucked out: the problem people moved out and their house was renovated. End of story. My heart still aches for how they neglected their dog. I did call animal control for that. No effect.
