Israel Is No Ally
But is it even a friend?

[This is an edited version of a speech given by me at the National Summit to Reassess the Israel-US Special Relationship, which took place at the National Press Center in Washington on March 7 th. The all day event included speakers Stephen Walt, Justin Raimondo, Paul Pillar, Jeff Blankfort, Alan Brownfeld, Philip Weiss, Ray McGovern and Scott McConnell. Inside the beltway types and the media constantly refer to Israel as an ally, which it is not. Israeli soldiers have never fought beside American troops and to be an ally you need an actual alliance on paper. No such legally binding document exists between Washington and Tel Aviv. Sycophants in congress are also fond of calling Israel Washington’s best or closest friend in spite of the fact that it does actual damage to the United States through using its considerable access to the government and media to promote policies that are good neither for the US nor for Israel itself. Recalling the expression that a friend does not let a friend drive drunk, one might observe that the United States has been driving drunk for quite some time, dangerous behavior that has to some extent been encouraged by Israel and its many supporters in Washington.

Israel might or might not have been an actual enabler of the disastrous American invasion of Iraq but it is undeniably true that the Pentagon officials who contributed to the “Clean Break” recommendations prepared for Benjamin Netanyahu in 1996 were subsequently behind the rush to war and the forgery of phony intelligence that fed the process. And Iran is Iraq redux. If the Washington goes to war with Tehran in the near future it will not be because Iranians actually threaten America, it will be because Israel and its powerful lobby in the US have succeeded in creating an essentially false casus belli to bring about such action.

Prime Minister Benjamin Netanyahu, who once commented that 9/11 was good for Israel, has repeatedly sought to commit the United States to draw red lines that would narrow options for the White House and de facto require it to take military action against Iran. Congress is meanwhile advancing legislation that would commit the United States to intervene militarily in support of a unilateral Israeli attack, meaning that Israel could easily be empowered to make the decision on whether or not the US goes to war.

Nothing relating to Israel is quite like how the US interacts with other countries. Direct grants, forgiveness of loans, charitable exemptions, and Pentagon co-production schemes all contribute to the dollar costs that go to support Israel, measures that are not in place for any other nation. Congress also recently approved by a 410 to 1 vote the United States Israel Strategic Partnership Act which grants to Israel an exemption from the reciprocity mandated by the so-called visa waiver program. Israelis will be able to travel freely to the United States while their government will be allowed to refuse entry to American citizens, a privilege granted to no other visa waiver country. One congressman has even introduced a bill to cut off federal funding for any academic organization that engages in boycotting Israel. Boycotting other countries is apparently okay.

Israel involves itself in American elections, most recently on behalf of Mitt Romney, it has corrupted our congress, its head of government publicly humiliates our own head of state, its government ministers insult and ridicule John Kerry, and its intelligence officers actually provide alarmist and inaccurate private briefings for American Senators on Capitol Hill. No other country interferes in our system in as many ways as Israel.

That Israel, accustomed to behaving with impunity towards its alleged friend and patron in Washington, might manufacture a pretext reminiscent of the Lavon Affair in Alexandria Egypt in 1954 or the false flag attack carried out on the USS Liberty in 1967 that killed 34 US sailors and civilians to draw the US into a new conflict is not unthinkable. Israel also strongly supports using force to intervene in Syria, a proposition that is opposed overwhelmingly by the American public. In short, Israel has no reluctance to use its enormous political and media clout in the US to pressure successive administrations to conform to its own foreign and security policy views.

One other very good reason why Israel should not receive a free pass on its behavior as well as billions of dollars in military assistance annually is its persistent espionage against the United States. American friends of Israel stole enriched uranium from a Pennsylvania refinery to create the country’s secret nuclear arsenal. More recently we have learned how Arnon Milchan, a Hollywood producer born in Israel, arranged for the illegal purchase of 800 nuclear triggers. He picked up his first Oscar on March 2 nd without any interference from the FBI.

The existence of a large scale Israeli spying network at the time of 9/11 has been widely reported, incorporating Israeli companies in New Jersey and Florida as well as hundreds of “art students” nationwide. Five Israelis from one of the companies were observed celebrating against the backdrop of the twin towers going down, the so-called “Dancing Shlomos.” Did Israel know in advance about 9/11? Many in the intelligence community believe that it certainly had knowledge of some aspects relating to the terrorist attack.

While it is often observed that everyone spies on everyone else, particularly true when one is referring to our own NSA, spying is a high risk business and most countries are extremely careful when spying on friends for fear of blowback. Israel, which relies on Washington for billions of dollars in aid and also for political cover in international fora like the United Nations, does not spy discreetly, largely because it knows that few in Washington will seek to hold it accountable. There were, for example, no consequences for the Israelis when Israeli Mossad intelligence officers using US passports and pretending to be Americans recruited terrorists to carry out attacks inside Iran. Israelis using US passports in that fashion puts every American traveler or businessman at risk.

Israel, where government and business work hand in hand, has obtained significant advantage by systematically stealing American technology with both military and civilian applications. The US developed technology is then reverse engineered and used by the Israelis to support their own exports with considerably reduced research and development costs, giving them a huge advantage against US competitors. Sometimes, when the technology is military in nature and winds up in the hands of an adversary, the consequences can be serious. Israel has sold advanced weapons systems to China that are believed to incorporate technology developed by American companies, including the Python-3 air-to-air missile and the Delilah cruise missile. There is evidence that Israel has also stolen Patriot missile avionics to incorporate into its own Arrow system and that it used US technology obtained in its Lavi fighter development program, which was funded by the US taxpayer to the tune of $1.5 billion, to help the Chinese develop their own J-10 fighter.

The reality of Israeli spying is indisputable. Jonathan Pollard, Ben-Ami Kadish, Stuart Nozette and Larry Franklin are spies for Israel who have been caught, but apart from Pollard they all received no or light sentences and are only the tip of the iceberg. Israel always features prominently in the annual FBI report called “Foreign Economic Collection and Industrial Espionage.” The 2005 report states “Israel has an active program to gather proprietary information within the United States. These collection activities are primarily directed at obtaining information on military systems and advanced computing applications that can be used in Israel’s sizable armaments industry.” It adds that Israel recruits spies, uses electronic methods, and carries out computer intrusion to gain the information. The 2005 report concluded that the thefts eroded US military advantage, enabling foreign powers to obtain expensive technologies that had taken years to develop.

A 1996 Defense Investigative Service report noted that Israel has great success stealing technology by exploiting the numerous co-production projects that it has with the Pentagon. “Placing Israeli nationals in key industries …is a technique utilized with great success.” A General Accounting Office (GAO) examination of espionage directed against American defense and security industries described how Israeli citizens residing in the US had stolen sensitive technology to manufacture artillery gun tubes, obtained classified plans for a reconnaissance system, and passed sensitive aerospace designs to unauthorized users. An Israeli company was caught monitoring a Department of Defense telecommunications system to obtain classified information, while other Israeli entities targeted avionics, missile telemetry, aircraft communications, software systems, and advanced materials and coatings used in missile re-entry.

The GAO has concluded that Israel “conducts the most aggressive espionage operation against the United States of any US ally.” In June 2006, a Pentagon administrative judge overruled an appeal by an Israeli who had been denied a security clearance, stating, “The Israeli government is actively engaged in military and industrial espionage in the United States. An Israeli citizen working in the US who has access to proprietary information is likely to be a target of such espionage.” More recently, FBI counter intelligence officer John Cole has reported how many cases of Israeli espionage are dropped under orders from the Justice Department. He provides a “conservative estimate” of 125 viable investigations into Israeli espionage involving both American citizens and Israelis that were stopped due to political pressure from above.

So is Israel an ally of the United States? The answer is most definitely no. Is it even a friend? Well, I suppose there are all kinds of friends in the world but if you judge Israel by its record on how it interacts with the American government and people I think the answer would also have to be no.

    By the way: Doesn’t John Kerry remember Colin Powell’s hilarious speech to the UN before the invasion of Iraq when he condemns “Russia’s incredible act of aggression in Ukraine” by saying: “You just don’t in the 21st century behave in 19th century fashion by invading another country on completely trumped up pre-text,”?

    Among the Romans amicitia applied to friendship, the patron-client relationships and alliances with foreign nations.

    In essence they took commitments to such relationships very seriously as a matter of culture and religion.

    In English it is easy–there is no such thing as a “friendship” between countries which, over time, usually results in the same kind of “friendship” seen in “friendly fire”, especially from the US side, as with Saddam Hussein and others.

    Philip Giraldi continues to falsely claim that “Congress is meanwhile advancing legislation that would commit the United States to intervene militarily in support of a unilateral Israeli attack,” when the legislation has been shelved, and the relevant provision is non-binding.

    The USS Liberty incident was not a false flag attack, as Israel never denied responsibility for the attack and immediately offered compensation.

    I think the testimony of American sailors aboard the Liberty can safely be taken over Nurit’s touching concern for the good name of her cousins overseas.

    Re: The USS Liberty incident. I freely admit that I’m not an expert on that. Does it say in the wiki page that the Israeli markings were covered up? I only skimmed it, and it actually said that a US Captain “noticed that the boats appeared to be flying an Israeli flag.” Can you post a link to a credible source reporting that their Israeli markings were covered up?

    According to Wikipedia, a false flag attack is a covert military or paramilitary operations designed to deceive in such a way that the operations appear as though they are being carried out by other entities, groups or nations than those who actually planned and executed them. Even if it were true that the Israeli aircraft were unmarked, that is not the same as a false flag attack, which would mean Israel was trying to pass off some other country as the attackers. In any case, the commander of the USS Liberty testified that he believed the torpedo boats to be carrying an Israeli flag:

    That some crew members did not see any markings is not inconsistent – in the fog of war, it is easy to miss such markings.

    Two hours after the attack, Israel informed the US embassy in Tel Aviv that it had attacked a US ship. How does this square with the attack being a false flag attack, as Giraldi alleged?

    1. The ABC witness did not report that they were dancing but rather smiling.
    2. ABC reports: “Despite the denials, sources tell ABCNEWS there is still debate within the FBI over whether or not the young men were spies. Many U.S. government officials still believe that some of them were on a mission for Israeli intelligence. But the FBI told ABCNEWS, “To date, this investigation has not identified anybody who in this country had pre-knowledge of the events of 9/11.” Sources also said that even if the men were spies, there is no evidence to conclude they had advance knowledge of the terrorist attacks on Sept. 11. The investigation, at the end of the day, after all the polygraphs, all of the field work, all the cross-checking, the intelligence work, concluded that they probably did not have advance knowledge of 9/11,” Cannistraro noted.”

You employ the same tactic every time you read something that you discern to be anti-Israeli or Jewish: you carefully select bits of the article that you find subject to nit-picking and then go at it in the belief that it will discredit the entire piece. My point is not whether or not ABC news reports a smile or a dance or whether there were counter-claims on Israeli plane markings but rather whether Israel, through its spying, its conniving at the US going to war, and its corruption of the US political system is even a friend, much less some kind of ally. It is not.

  18. NB nitpicks the smallest details in persistent attempts to find a flaw. What else can he do? The overarching analysis and conclusions are beyond question and there is no effective argument against them.

    This is the standard reaction of the pro-Israel operative to any and every detailed critical analysis of Israeli perfidy: Examine the report with a microscope, find something – anything – that can be exploited as though it were a significant error, and make more of it than is reasonable.

    Your position on the USS Liberty incident is bogus. This was a false flag attack inasmuch as the plan was to sink the Liberty with all hands so that the incident could be blamed on Egypt to push the US to joining the war against them. Unfortunately, for the Israelis, the ship,with US Navy markings and flying a large US flag, refused to sink even after prolonged bombing, strafing, napalming, rocketing, torpedoing and machine-gunning lifeboats – an attack that lasted longer than the attack on Pearl Harbor. When the attack failed and living witnesses were left to scream bloody murder, the Israelis came up with the “mistaken identity” excuse even though they had been reconning the Liberty all day prior to the attack and an attacking pilot stated to his controllers that the ship was a US ship, but were told to attack anyway.
    Most in the Johnson administration knew and stated that the attack was deliberate but covered it up so as not to embarrass the tender feelings of Israel. Tough on the 34 US sailors killed and 174 wounded- that’s 72% casualties.

    When caught red-handed, the Israelis apologized and paid $3 million in reparations- what a joke, especially since the US gave them the money in the first place.

  25. “Hell has no fury like a woman scorned.” I wonder what exactly Ron Unz did during their communications to set her off (or was it prior to that?). Also she carefully does not elaborate on her positions (if not out right refusal to deviate from her agenda to answer pertinent questions regarding where she is coming from) concerning Israel and the rest of the world, so people will mistake her for Netanyahu, share their feelings towards Israeli right wing policies, providing ammo and fuel for another round of poor Giraldi having to approve comments. I wish people would stop responding until she gives her version of what should happen regarding the Israeli occupation, settlements, Palestinian state borders, American Iran policy, and how she feels about liberal Jews like Mondo Weiss and Max Blumenthal and why. It would be far more interesting than her attempts to paint this site and its readers as if they were stormfront where there is actual anti-semitism. I find people’s ethnic nationalism (whatever it is) irritating. Whatever is broken deserves an ethnography and psychological treatment.

The facts you’ve given in this article are really beyond question for anyone who does not come to the table with their own agenda. Israel’s apologists are sophists who argue incessantly over minutiae to derail the larger, undeniably correct, argument. Israel is no friend to the US. Israel is not a US ally. It is past time to end the “special relationship” that benefits only Israel at very considerable US expense.

    I got a kick reading the list of attendees at this conference. It’s a Who’s Who of virulently anti-Israel activists and overt anti-Semites. Giraldi himself is employed by a viciously anti-Israel organization with links to Holocaust revisionists and receives substantial Saudi funding (talk about a great US ally!)

    The fact is polls consistently show most Americans have a positive view of Israel. Israel is getting stronger and wealthier as the Arab world has imploded. Let Giraldi & Co stew in their own hatred. Israel is here to stay.

I see only mainstream observers from many backgrounds who deplore the grip that Israel has on United States policymakers and policy. The organization that I am executive director of, Council for the National interest, does not have any position at all on the holocaust and accepts no foreign funding. The American positive view of Israel comes from a steady diet of misinformation from the mainstream media.

    I will never forget the treachery committed by the Zionists and President Johnson excusing their actions as a “fog of war”. On a clear sunny day the Israeli Navy attack boats tried to kill unarmed sailors in life rafts as they tried to escape the heavily damaged USS Liberty, an American reconnaissance vessel operating in international waters. They are a monstrous regime and must be condemned and severely punished for their heinous acts of barbarism.

Any fair-minded individual would be able to see that (esp if they read your Quitting over Syria piece and read my comment). Congress is not and never was advancing any legislation that commits the US to intervene militarily in the event of an Israeli unilateral attack.

    I call into question your integrity by showing this pattern.     The article is good but too kind.

    1. According to the Symington Amendment it is illegal for the US to give any kind of financial support to nations which enrich uranium without being a signatory of IAEA. Therefore, the massive fianncial support of Israel is violating US law.

    2. There is an asymetrical visa legislation between the US and Israel, which is unheard of in the relationship between sovereign nations. What is much worse is that there is a similar asymetrical relationship in the field of defense, based on legislation passed by Congress. This means that the US is legally bound to defend Israel even in situation when it is Israel itself which has started a war of aggression, which may even contravene international law. Israel does not have any obligation to support the US in case it is attacked.

    I can only draw the conclusion that the US is no longer a sovereign nation but has been reduced to Israel’s Dependencies in North America (DNA). Its membership of international oranizations like the UN should therefore be carefully reconsidered and the immunity of its so-called diplomats should be reconsidered as well.

    I cannot say whether the Israeli enslavement of the US is based entirely on corruption of the political system based on an USD carrot (funded from a small portion of the US tax dollars funnelled to Israel) and a stick based on threats of political and personal destruction in case that economic and sexual crimes committed by the congressmen will be published.

    An even more sinister possibility is that the US Government is being blackmailed with threats of detonation of pre-positioned nuclear weapons. The radioactivity measured at the Israeli consulate in New York lends credibility to such possibility, which is fully in line with the known Samson Option.

All the nit picking is meant to draw out the debate until it becomes noxious to those who hold the “Wrong” position. It’s an old, old trick employed by politicians. The hostility I sense reminds me of people who I have known who suffered from paranoid personality disorder. It is really unpleasant dealing with people who are hostile, secretive, and think you are out to get them. All fair minded people like other people to be forth coming in their dealings. When I read her posts I cannot help but think about white ethnic nationalist who have a preoccupation with race. Because of this it is comical when she gets all holier than thou with individuals she disapproves of. The moralism is even more absurd when you consider that what we all want is for the US to stop funding the Israeli occupation of Palestine.   44. It is now clear that when Israel attacked the USS Liberty, it had every intention of sinking the ship, and leaving no survivors to testify as to who attacked it. As a classic false flag attack, Israel’s assumed that once the ship was sunk and all survivors had been machine gunned, the US would automatically assume Egypt had carried out the attack, and attack Egypt in retaliation. Modern Israel has a long record of false flag attacks, with the King David Hotel attack being among one of the first, and 9/11 being one of the later.

    @NB I agree the USS Liberty attack was not a false flag in the truest sense, rather it was a continuation of the strategy of Israel to commit an illegal act (in this case an act of war), claim it was an “accident” (I believe they claimed the ship was Egyptian) and then ask for forgiveness. Lyndon Johnson, who was President, had a close adviser who was Jewish. Easy to get someone with Zionist sympathies to prevail upon the President to close the matter by misusing a gentile’s sympathies. Anyone with a teaspoonful of sense can see this, it’s not even very clever. The other argument that is used (one my Jewish neighbor used with me when we discussed the situation in Palestine) is a tacit implication of the responsibility of all gentiles for the holocaust, and playing upon the guilt they wish us to accept. My neighbor, having no further argument to make, said to me “I’m afraid people will say we’re tired of Jews”. The most crude, rank sort of emotional manipulation, that represents an appalling chauvinism, but it doesn’t work on me, it just makes me angry.

    By the way, I don’t accept the correctness of the appellation “anti-semite” to describe discrimination or dislike of Jews, or criticism of Israel and its actions. Every leader of Israel talks about the “Jewish” state, we hear that Palestinians must recognize Israel as the “Jewish” state, so what’s with the anti-semitic trope? I’ve never heard Israel called the “semitic” state, so let’s stop using that meaningless adjective.

  52. The case of Jonathan Pollard needs further clarification. He stole the names of our Russian agents in the Kremlin and gave/sold them to Israel. They in turn, auctioned them to the KGB in return for the release of tens of thousands of Russian Jews to Israel and to the USA. Our spy network was immediately murdered by the Kremlin; there number unknown but likely in the dozens. An interesting aspect to this is that Pollard was unlikely to have gathered his information on his own being of low ranking; a mole or moles likely remain in Navy Intelligence.
    Two points regarding to USS LIberty. #1 Israel never paid the promised compensation to the families of the 32 naval personnel and 1 civilian killed. #2 The Liberty was tracking the telecommunication of the IDF as they went about killing 1400 Egyptian prisons of war in El Alarish in the Sinai during the 1967 war. As a footnote, CIA revenge for the Liberty (probably without the knowledge or consent of LBJ and McNamara) was instant. The nest day the Israeli gunboat, the Eliat, with 23 aboard disappeared in a flash; the cover story was that that it was hit by a SCUD from Alexandria, Egypt. Those things couldn’t hit the Mediterean, never mind a ship 50 plus miles away.
    Hats off to Giraldi and others like Raimondo, Margolis, PC Roberts, Buchann, and Sibel Edmonds who champion truth and humanity. They are our modern day patriots!

Tribalism is slowly becoming unacceptable in a heavily populated multicultural world. I live in a society where ethnic nationalism and European colonialism is frowned upon and I am supposed to support a colonial project overseas? You expect me to believe in two contradictory beliefs at once? I am supposed to engage in doublethink? This causes me cognitive dissonance. It doesn’t even pass the self interest test. What do I get out of it? I may convert for the right price.

    What is interesting is religious aspect of war making. Ultra-Orthodox Jews are said to hold right wing policy views. I’m curious to see if the new law in Israel has a pacifying affect on them. Do the majority of Christian Zionist fight? No. Do the majority of Salafist Muslims fight? No thank god.     “Roland Popp, the scholar who sent me the Nixon memo where RMN inveighed against “domestic political considerations” when it came to Mideast policy, has sent me two other letters in a related vein, ones he picked up at the LBJ Library. I can’t link them; there are copyright issues. But let me quote and summarize.

    The first letter was written by then-Senator Lyndon Johnson to John Foster Dulles, Eisenhower’s secretary of state, in February 1957 after the Suez crisis. LBJ was then the Democratic leader in the Senate. The letter is a stern admonition to Dulles that he should not pressure Israel to withdraw from Gaza and lands in the Sinai near the Gulf of Aqaba, lands it had occupied in the ’56 war, which it had initiated, along with England and France.

    “I feel I should tell you, most frankly, how disturbed I have been by recent stories in the press, which stories have appeared under the bylines of most reputable correspondents, that serious consideration is being given in the General Assembly of the United Nations to imposing economic sanctions against the State of Israel.” These sanctions would be “unwise” and unfair. One has to look at the “root causes” of the trouble in the Middle East, Johnson said, and one of these causes is that when Israel withdraws from these lands it will have no guarantee of security from Egyptian attacks. “[T]he merits, the justice, and the morality in this situation are clear,” Johnson wrote.

    The second letter is the stunner. It was penned a week later, from New York, by the president of the American Jewish Committee. “I realize that your letter to the Secretary of State on February 11, is off the record and not subject to any public treatment,” said Irving Engel. But the Senator had passed on a copy to Engel, in confidence, through a Jewish lawyer. Engel went on:

    “With this letter you have, to my feeling, truly lived up to the meaning of the Ecclesiastes’ word: “There is a time to keep silent, a time to speak.” You have, Senator, spoken the frank and creative words of a statesman, a guardian of the moral principles of America, and a defender of the true interests of this country. On behalf of the American Jewish Committee… I wish to give you thanks for a momentous act of wisdom and courage.”

    I’m not historian enough to judge the Suez question. Israel did
    withdraw from those territories, and Egypt’s subsequent militarization of the border
    led (probably along with Israel’s getting the bomb from France) to the ’67 war. But it never ends. Today the rationale is offered, as it was 50 years
    ago, that Israel cannot withdraw from the West Bank because it would be
    vulnerable to attack if it did so.

    What the two letters offer is an echo of what Abba Eban said in an essay I mentioned the other day: the crucial importance to Israel of American Jewish “pressure and influence” on U.S. policymakers back in the 50s and 60s. Why was the Jewish community so important to a senator from Texas? Johnson had been put forward as a presidential candidate in ’56, he would run again in ’60. Johnson was a political animal; and his blunt letter to Dulles seems a transparent effort to cultivate support from Jews. He kept the letter private while making sure it got to big Jews in New York. It is important to remember that Dulles was widely despised in the Jewish community; he had backed Hitler through the early 30s. A “bastard,” I remember hearing in my childhood.

    A cursory search of Johnson biographies suggests that no one has written about this episode. As Engel said, there’s a time to be silent and a time to speak. Isn’t it time to speak of this neverending element in our politics? —

    The intent was to sink the USS Liberty with no survivors.There was no need to conceal the Israeli war machines.The intent was to blame Egypt so that the US could then attack one of Israel’s major enemies from that front.

    The one thing that i remember the most clearly over the past 40 years of my school days at Brandeis University in 1970′s are my student adviser’s words that when he was growing up that his grand parents and parents used the term “‘goyishe kup,’” meaning that the “Non-Jews are Stupid”
    Later in life I learned that the exact translation of “GOYISHE KUP” means that the “Cattle are STUPID”..
    I remember him recalling what his father told him when he was growing up in Eastern Europe. One of them being that when his father was in high school he and a group of friends would skip school early on Fridays and go over to his friend’s father’s butcher shop. That they would buy at cost any cows , that had not been butchered by the end of the day on Friday before the start of Shabat . They would take the cow home and wash it and then the boys would procede to “beat the udders of the cows so that they would swell up and turn pink” so as to sell them to the “GOYISHE KUP” as milk producing cows.
    The part that I remember him asking me if the East Europeans are so “naive, so gullible and so stupid” to buy an old “non milk producing cows” from a bunch of young Jewish Boys.
    So re-thinking of it now I agree with the Jewish saying that the “GOYISHE KUP” are indeed” Stupid” as they believe that a Bunch of Arab Moslem Kids who were not able to Fly a Cessna Airplane took it upon themselves to FLY a Jumbo 747 and outwitted the US Militaryand Civilian authorities. The “Jewish Lightning Insurance Scam” of the 1960′s is still alive and well has been put to good use by Larry Silverstein in putting 15 million down and comming out with 7 billion dollars for buidings that no one wanted to buy because it would have cost a billion dollars to remove the asbestos from. Then on top of that the people in America actually believe that they actually decide who is elected President or for that that actual VOTE is really counted and makes a difference in deciding who represents them in the White House and congress.

    Below the Constitution are acts of Congress. When two acts of Congress conflict, we use English common law to determine which prevails. Here, you have identified a conflict between two acts of Congress: (1) no money for “nations which enrich uranium without being a signatory of IAEA” and (2) the repeated acts of Congress to provide Israel with various forms of assistance.

    To resolve this conflict between two acts of Congress, two common law principles apply.

    First, the newer law trumps the older law.

    Second, the specific trumps the general.

    In both cases, the particular acts directing funds toward Israel are both newer and more specific than the conflicting Symington Amendment.

    I hope this helps clarify the matter.
